Rights and Usage Policy

Throughout this Rights and Usage Policy, “The Sanctuary of Fragility” may be referred to as “TSOF.” In this policy only, “TSOF” is used as a shortened reference to The Sanctuary of Fragility for convenience. It is not intended to replace the project name, to serve as the project’s public-facing name outside this policy, or to refer to any unrelated person, group, artist, band, organisation, project, service, or third party that may use the same or similar abbreviation.

The Sanctuary of Fragility is the public-facing project name and rights-management identity for the materials, releases, policies, permissions, communications, and activities controlled, administered, or expressly authorised by the project. The use of The Sanctuary of Fragility or “TSOF” in this policy does not make the project ownerless, unclaimed, unauthorised, or available for third-party ownership, control, registration, or rights claims.

In this policy, “TSOF” may include The Sanctuary of Fragility as a project, its official website, official social-media accounts, official music and podcast releases, official written materials, and other materials, releases, communications, or activities published, controlled, administered, or expressly authorised by The Sanctuary of Fragility.

Where applicable, “TSOF” may also include any collaborator, contractor, representative, manager, rights administrator, publisher administrator, licensing administrator, or other person or entity acting on behalf of The Sanctuary of Fragility, but only to the extent of their written authorisation and only for the specific rights, materials, purposes, territory, platform, period, or activity covered by that authorisation.

Nothing in this definition makes any collaborator, contractor, representative, manager, administrator, platform, distributor, service provider, user, fan, cover artist, or third party an owner of The Sanctuary of Fragility or gives them any general authority to make decisions, grant permissions, waive rights, speak for, endorse content on behalf of, or bind The Sanctuary of Fragility beyond the specific authority expressly granted to them in writing.

For clarity, the use of the name “The Sanctuary of Fragility” or “TSOF” in this policy does not imply that every platform, distributor, service provider, collaborator, user, fan work, cover, adaptation, repost, playlist, video, short-form post, or third-party content involving The Sanctuary of Fragility material is created, reviewed, approved, endorsed, controlled, or accepted as responsibility by The Sanctuary of Fragility.

Copyright Notice

Unless otherwise stated, the original lyrics, transcripts, translations, lyrical adaptations, written materials, policy texts, website texts, podcast-related texts, release descriptions, captions, and other copyright-protected materials created for, published by, controlled by, or expressly authorised by The Sanctuary of Fragility are protected by copyright and other applicable rights to the extent recognised by applicable law.

These materials may not be copied, reproduced, republished, distributed, translated, adapted, modified, extracted, scraped, compiled, used for training datasets, used to create derivative works, used for commercial purposes, or otherwise used without prior written permission from The Sanctuary of Fragility, except where such use is expressly allowed by this Rights and Usage Policy, by a separate written permission from The Sanctuary of Fragility, by the applicable terms of an official platform feature, or by applicable law.

This Copyright Notice does not claim ownership of third-party materials, platform materials, service-provider materials, distributor materials, stock assets, fonts, templates, tools, software, AI services, or other materials owned or controlled by third parties. Any such materials remain subject to their own applicable terms, licences, and rights holders.

Any explanation of The Sanctuary of Fragility’s creative process, AI assistance, drafting process, translation process, prompt process, arrangement notes, metadata preparation, or other working method is provided for transparency only. It does not grant permission to copy, extract, reuse, remix, reproduce, distribute, claim, register, commercially use, or otherwise exploit any lyrics, audio, written materials, releases, drafts, outputs, or other materials controlled by The Sanctuary of Fragility.

The fact that any material is made available online, published on a platform, included in a post, discussed in a podcast, shown as part of a creative-process explanation, or made accessible for reading, listening, viewing, sharing, or platform-based use does not mean that the material is public domain, free to use, unclaimed, ownerless, abandoned, or available for third-party ownership, registration, rights claims, Content ID claims, monetisation claims, or commercial exploitation.

All rights not expressly granted are reserved.

Rights and Ownership Notice

The Sanctuary of Fragility owns, controls, administers, or is authorised to administer certain rights in the materials, releases, policies, permissions, communications, and activities created for, published by, controlled by, or expressly authorised by The Sanctuary of Fragility, except where otherwise stated.

These rights may include, without limitation, rights in original lyrics, transcripts, translations, lyrical adaptations, written materials, website texts, policy texts, podcast-related texts, release descriptions, captions, project statements, selected titles, project-specific wording, and other copyright-protected expression created for or controlled by The Sanctuary of Fragility, to the extent recognised by applicable law.

The Sanctuary of Fragility also controls the official use of its project name, public-facing identity, official website, official social-media accounts, official music and podcast releases, official written materials, official policies, official permission processes, and official communications, except where a specific platform, distributor, collaborator, contractor, administrator, or service provider controls its own separate rights, services, systems, accounts, tools, materials, or terms.

For English translations and lyrical adaptations, The Sanctuary of Fragility claims rights only in the human-authored expression, selection, arrangement, revision, and final lyrical decisions contained in those translations and adaptations, to the extent recognised by applicable law. Any use of AI assistance in the creative process is described in the Creative Process & AI Assistance section of this policy.

The Sanctuary of Fragility does not claim ownership of third-party materials, platform materials, distributor materials, service-provider materials, stock assets, fonts, templates, software, tools, AI services, or other materials owned or controlled by third parties. Such materials remain subject to their own rights holders, licences, service terms, and applicable laws.

The Sanctuary of Fragility does not claim that AI-generated music elements are human-composed, human-performed, or human-authored. Any release, distribution, monetisation, or commercial use of audio generated with AI music services is subject to the applicable terms, policies, rights, limitations, and legal status of those services and of applicable law.

Permission from The Sanctuary of Fragility covers only the rights that The Sanctuary of Fragility owns, controls, administers, or is authorised to administer. It does not replace any licence, permission, approval, clearance, payment, attribution, platform compliance, distributor requirement, service term, legal requirement, or third-party right that may be required from any other person, platform, distributor, service provider, rights holder, publisher, collective management organisation, licensing body, or authority.

No person, platform, distributor, service provider, collaborator, contractor, administrator, user, fan, cover artist, or third party may claim ownership of, register, monetise, administer, Content ID claim, falsely attribute, or otherwise assert rights over The Sanctuary of Fragility materials, releases, project identity, lyrics, translations, adaptations, audio, written materials, or other controlled materials, except to the extent expressly authorised in writing by The Sanctuary of Fragility or permitted by applicable law.

Nothing in this Rights and Ownership Notice limits the ability of The Sanctuary of Fragility to use, reuse, publish, revise, adapt, translate, distribute, monetise, license, administer, remove, enforce, or otherwise manage its own materials, releases, rights, policies, permissions, and project identity. Any restriction placed on third-party use does not restrict The Sanctuary of Fragility itself, or any collaborator, contractor, representative, administrator, or other authorised person or entity acting for The Sanctuary of Fragility within the scope of written authorisation.

Creative Process & AI Assistance

The Sanctuary of Fragility began with original Thai lyrics written by the human creator behind the project. The lyrical concepts, emotional meaning, narrative, imagery, interpretation, and creative intent originated from that human creator.

For the English versions, AI tools—primarily ChatGPT—were used as interactive language-reference and language-checking tools, similar to an advanced dictionary, usage guide, and grammar checker. These tools provided vocabulary, phrasing, idiom, and translation or adaptation alternatives; explained differences in nuance, tone, and emotional effect; and assisted with grammar, naturalness, and back-translation checks.

The human creator determined the intended meaning and emotional context, selected or rejected suggested words and phrases, assembled and revised the English lines, and made all final lyrical decisions. The AI tools did not independently determine or produce the final lyrics.

Gemini was used separately as an additional language cross-checking tool for meaning, grammar, nuance, and naturalness.

The song structure, emotional progression, genre, mood, and arrangement concept were developed under the creative direction of The Sanctuary of Fragility. AI tools were also used to explore musical terminology and to help express those creative directions as arrangement notes, structural tags, and prompts for SUNO.

The final audio was generated using SUNO from the lyrics, prompts, song structure, mood, genre direction, and arrangement instructions provided under that creative direction.

Only tracks created while using a SUNO plan that grants commercial-use rights are released or used commercially by this project. Commercial-use rights are subject to SUNO’s applicable terms and policies.

No real artist’s name, identifiable real artist’s voice, or deliberate imitation of any specific performer was requested or used in the prompts.

This section explains the creative process of The Sanctuary of Fragility and is provided for transparency. It does not grant permission to copy, extract, reuse, remix, reproduce, distribute, claim, register, commercially use, or otherwise exploit any lyrics, audio, written materials, releases, drafts, outputs, prompts, arrangement notes, metadata text, or other materials controlled by The Sanctuary of Fragility.

The disclosure of AI assistance in the creative process does not mean that any The Sanctuary of Fragility material is public domain, ownerless, unclaimed, free to use, free to copy, or available for third-party ownership, registration, Content ID claims, monetisation claims, dataset use, model training, commercial exploitation, or unauthorised derivative works.

All rights not expressly granted are reserved.

Use Through Official Platform Music Libraries

Where a The Sanctuary of Fragility track is made available through an official platform music library, sound library, audio catalogue, commercial music library, commercial sound library, built-in music feature, or similar platform-provided audio feature, users may use that track only through the relevant platform feature and only within the rights, limits, territories, account types, monetisation rules, commercial-use rules, content rules, technical limits, and other terms provided by that platform.

This may include, where applicable, platform features provided by services such as TikTok, CapCut, YouTube Shorts, Instagram, Facebook, or similar services. The mention of any platform in this policy is illustrative only and does not mean that the same rights, limits, permissions, monetisation rules, commercial-use rules, or content rules apply across all platforms.

If a user selects and uses a The Sanctuary of Fragility track through an official platform music library or similar platform-provided feature in accordance with that platform’s applicable terms, no separate notification form, permission request, or approval from The Sanctuary of Fragility is required for that platform-based use.

However, any such use is made under the platform’s own system and terms. It does not mean that The Sanctuary of Fragility has reviewed, approved, endorsed, sponsored, participated in, collaborated on, supervised, controlled, or accepted responsibility for the user’s content, message, interpretation, account, product, service, campaign, organisation, belief, political position, religious position, ideology, brand, advertisement, or other activity.

The availability of a The Sanctuary of Fragility track through an official platform music library does not grant any right to download, extract, copy, record, separate, scrape, reproduce, re-upload, redistribute, modify, remix, sample, use outside the platform feature, use in another platform, use in an advertisement outside the platform’s authorised system, create a soundalike or substitute audio file, create or claim a derivative audio work, register rights, make a Content ID claim, make a monetisation claim, or otherwise use any The Sanctuary of Fragility audio outside the rights expressly provided by the relevant platform.

Users are responsible for confirming that their own use complies with the applicable platform terms, account type, territory, content rules, commercial-use rules, advertising rules, brand-use rules, music-library rules, community guidelines, and all applicable laws. The Sanctuary of Fragility does not provide individual clearance, legal advice, platform-compliance review, advertising approval, brand approval, political approval, religious approval, or content endorsement for platform-library uses.

The use of a The Sanctuary of Fragility track through an official platform music library does not give the user any right to imply that The Sanctuary of Fragility supports, agrees with, sponsors, endorses, collaborates with, is affiliated with, or is responsible for the user, the user’s content, or the user’s message. Users must not use The Sanctuary of Fragility’s name, project identity, official artwork, logos, written materials, lyrics, captions, statements, or other controlled materials in a way that falsely suggests approval, endorsement, affiliation, collaboration, sponsorship, or official participation by The Sanctuary of Fragility.

The Sanctuary of Fragility does not support or endorse the use of its materials for political campaigning, partisan promotion, religious promotion, cult promotion, propaganda, hate, harassment, discrimination, dehumanisation, glorification of violence, incitement, exploitation of vulnerable people, or other harmful, misleading, or abusive contexts. If such content appears through a platform music-library use, The Sanctuary of Fragility may not be able to prevent every platform-based use in advance, but it reserves the right to state its position, reject any implied association, report content to the relevant platform, request correction or removal where available, or take any other action reasonably available within the relevant platform rules, contractual rights, applicable law, and practical limits.

For clarity, this section applies only to use made through an official platform-provided music, sound, audio, or similar feature. It does not permit any use of The Sanctuary of Fragility master recordings, instrumental recordings, backing tracks, isolated vocals, stems, project audio files, SUNO-generated audio outputs, edited audio files, excerpts, snippets, short audio clips, or any other The Sanctuary of Fragility-controlled audio files outside such official platform feature.

The Sanctuary of Fragility may choose, at its discretion, whether to make any particular track available through any platform music library, commercial music library, sound library, audio catalogue, distributor service, or similar feature. The absence of a track from a platform music library does not create any right for users to upload, copy, extract, recreate, distribute, or otherwise make that track available themselves.

All rights not expressly granted are reserved.

Unreleased, Pre-Release, and Not Yet Officially Presented Materials

For the purposes of this Rights and Usage Policy, “Unreleased Materials” means any content, work, material, asset, concept, file, information, or project element that is created, developed, commissioned, owned, controlled, or lawfully held by The Sanctuary of Fragility, to the extent of the rights held or controlled by The Sanctuary of Fragility, and that has not yet been officially released or officially presented by The Sanctuary of Fragility for public use.

Unreleased Materials may include, without limitation:

𑇐 lyrics, compositions, melodies, musical ideas, arrangements, recordings, demos, stems, sessions, mixes, masters, production files, and other audio materials;

𑇐 scripts, podcast materials, outlines, narration, interviews, research, notes, transcripts, drafts, and unpublished text;

𑇐 illustrations, artwork, designs, mascots, characters, logos, photographs, animation, video, storyboards, visual-development materials, and production assets;

𑇐 stories, fictional settings, names, titles, concepts, formats, themes, campaigns, programmes, educational materials, and creative-development materials;

𑇐 websites, applications, interactive works, games, events, exhibitions, merchandise concepts, products, services, and other media or project formats;

𑇐 working files, internal documents, schedules, release plans, production plans, private communications, previews, excerpts, prototypes, tests, samples, and incomplete versions; and

𑇐 any future category of work, media, technology, product, service, activity, or creative format developed, commissioned, owned, controlled, or lawfully held in connection with The Sanctuary of Fragility.

The examples in this section are illustrative only and do not limit the meaning or scope of Unreleased Materials.

Official Release and Public Availability

Material does not cease to be Unreleased Material merely because it has been:

𑇐 registered with a copyright, rights-management, authorship, publishing, archival, or similar service;

𑇐 indexed, catalogued, listed, deposited, recorded, or made searchable in a database;

𑇐 disclosed in an application, registration, filing, record, catalogue, or administrative system;

𑇐 privately shared with a collaborator, contractor, adviser, service provider, tester, reviewer, guest, or other recipient;

𑇐 shown during a private meeting, rehearsal, production session, presentation, consultation, or review;

𑇐 disclosed to a limited audience;

𑇐 partially revealed through a teaser, preview, excerpt, quotation, screenshot, photograph, clip, livestream, behind-the-scenes post, announcement, or promotional material;

𑇐 visible, searchable, accessible, obtainable, or discoverable through a public or private source;

𑇐 leaked, copied, forwarded, uploaded, published, or otherwise disclosed without authorisation;

𑇐 publicly accessible but not yet officially released or officially presented by The Sanctuary of Fragility; or

𑇐 announced as a future project, song, episode, character, release, or other work.

Public visibility, discoverability, registration, partial disclosure, or unauthorised availability does not by itself constitute an official release, permission for public use, or a waiver of rights.

A work is treated as officially released or officially presented only when The Sanctuary of Fragility, or a person expressly authorised by The Sanctuary of Fragility, intentionally makes that work available in an official form, through an official channel, for the relevant public purpose.

An official release of one part, version, format, language, excerpt, episode, file, or element does not automatically release or authorise the use of any other part, version, format, language, draft, source file, underlying material, or related project element.

Unreleased Lyrics and Musical Development

Lyrics that have not yet been officially developed and released as a song by The Sanctuary of Fragility remain Unreleased Materials, even where the lyrics have been registered, indexed, publicly listed, partially disclosed, discovered, accessed, or obtained.

Such lyrics are not made available for:

𑇐 composing or adding music;

𑇐 creating a melody, arrangement, instrumental, or accompaniment;

𑇐 recording or producing a song;

𑇐 translating or lyrically adapting the text;

𑇐 performing, reciting, singing, or publishing the lyrics;

𑇐 creating a demo, cover, remix, mashup, medley, or derivative work;

𑇐 submitting the lyrics or a resulting recording to a platform, distributor, publisher, contest, organisation, or third party; or

𑇐 presenting the resulting work as original, authorised, collaborative, official, or approved.

Creating music for unreleased lyrics is not an ordinary cover and is not a use permitted through the General Cover Notification Form.

The fact that lyrics may be discoverable through a registration record, database, catalogue, filing, archive, search process, private disclosure, partial public disclosure, or other source does not grant permission to develop those lyrics into a song.

Songs and other works may be subject to a planned creative, narrative, production, promotional, or release sequence. That sequence remains under the control of The Sanctuary of Fragility to the extent of its rights.

A person must not interfere with that sequence by independently producing, releasing, announcing, circulating, or publicly presenting an unreleased work or an unauthorised version derived from it.

A person genuinely interested in developing unreleased lyrics, music, or another unreleased project element must contact The Sanctuary of Fragility before beginning the proposed use.

Discussion, interest, access to materials, submission of an enquiry, or an invitation to provide information does not grant permission to begin composing, recording, translating, adapting, producing, performing, publishing, promoting, or otherwise using the material.

No such use may begin unless The Sanctuary of Fragility has expressly authorised it in writing and the relevant parties have completed any necessary agreement.

No Permission Arising from Access or Receipt

Access to or possession of Unreleased Materials does not grant any ownership, licence, permission, consent, or other right to use them.

This applies even where the person received or accessed the materials lawfully, including as a:

𑇐 collaborator;

𑇐 commissioned artist or creator;

𑇐 performer;

𑇐 producer, engineer, editor, designer, translator, developer, or other contractor;

𑇐 employee, adviser, consultant, volunteer, intern, or service provider;

𑇐 publisher, distributor, administrator, platform, or professional representative;

𑇐 tester, reviewer, researcher, guest, or invited audience member; or

𑇐 recipient of a private preview, sample, draft, link, file, or communication.

Such a person may use the materials only within the scope, purpose, period, and conditions expressly authorised in writing.

Permission to view, evaluate, discuss, test, review, edit, translate, perform, produce, store, or otherwise handle material for one limited purpose does not grant permission to publish, disclose, reuse, adapt, retain, distribute, or exploit it for another purpose.

Where no written permission is provided, no permission to use or disclose the Unreleased Materials should be assumed.

Prohibited Unauthorised Activities

Unless expressly authorised in writing, a person must not:

𑇐 copy, download, record, reproduce, retain, extract, archive, or create additional copies of Unreleased Materials beyond what is necessary for an authorised purpose;

𑇐 publish, upload, post, livestream, broadcast, perform, exhibit, distribute, sell, license, sublicense, transfer, forward, or otherwise make the materials available;

𑇐 compose music for, record, translate, adapt, edit, complete, reconstruct, imitate, or create derivative material from them;

𑇐 use the materials to train, test, prompt, fine-tune, evaluate, or develop an artificial-intelligence system, model, dataset, application, or automated service;

𑇐 submit the materials to a distributor, publisher, collection society, rights administrator, copyright or registration service, platform, database, contest, festival, institution, or other third party;

𑇐 claim ownership, authorship, co-authorship, approval, collaboration, representation, or another official relationship without an independent lawful basis or express written authorisation;

𑇐 claim, register, or attempt to register ownership, authorship, copyright, trademark rights, metadata, Content ID assets, domain names, accounts, profiles, identifiers, or similar rights or records based on the Unreleased Materials where the person does not independently hold the relevant rights or has not been expressly authorised to act on behalf of the lawful rights holder;

𑇐 use the materials to gain attention, followers, publicity, commercial advantage, negotiating leverage, reputation, or access to a project;

𑇐 reveal or confirm confidential creative plans, release schedules, story developments, production details, participants, or other non-public information; or

𑇐 encourage, assist, commission, instruct, or enable another person to engage in such activity.

Nothing in this provision prevents a person from registering, maintaining, or using a right, account, profile, domain name, identifier, or other record that they independently and lawfully own or control.

However, merely accessing, receiving, or possessing Unreleased Materials does not transfer ownership or authorise a person to claim any right belonging to The Sanctuary of Fragility or another lawful rights holder.

A person must not attempt to avoid this section by using only part of an unreleased work, recreating it from memory, changing its form, translating it, combining it with other material, or publishing a version claimed to be independently developed where it was actually derived from Unreleased Materials.

Accidental Discovery, Leaks, and Unauthorised Disclosure

A person who discovers, receives, or accesses Unreleased Materials without clear authorisation is requested to:

𑇐 not use, copy, adapt, translate, record, perform, publish, or distribute the materials;

𑇐 not forward, repost, quote, describe, summarise, or otherwise increase access to them;

𑇐 stop any ongoing unauthorised use;

𑇐 remove copies, posts, uploads, files, or links under their control where reasonably possible; and

𑇐 contact The Sanctuary of Fragility to report the discovery, disclosure, or source before taking any further action.

Where the person is required by law, professional duty, platform procedure, security process, or another legitimate obligation to retain or disclose certain information, they should limit the retention or disclosure to what is reasonably necessary and lawful.

Reporting an apparent leak or unauthorised disclosure does not grant the reporting person any right to retain, use, publish, investigate, exploit, or circulate the materials.

The Sanctuary of Fragility may request information reasonably necessary to identify the material, source, location, scope, or impact of an unauthorised disclosure.

Requests to Use Unreleased Materials

A person interested in an unreleased work may contact The Sanctuary of Fragility to propose a collaboration, commission, licence, production, development, or other arrangement.

Any such contact is a preliminary enquiry only.

It does not:

𑇐 grant access to additional materials;

𑇐 authorise the person to begin work;

𑇐 create confidentiality unless separately agreed;

𑇐 reserve the material or opportunity;

𑇐 create an obligation to negotiate or respond;

𑇐 establish collaboration, partnership, employment, representation, exclusivity, or joint ownership; or

𑇐 guarantee that permission or an agreement will be offered.

The Sanctuary of Fragility may approve, decline, limit, postpone, or propose a different structure for any request.

A proposed use may begin only after express written permission has been provided and all necessary terms have been agreed.

Permission relating to one unreleased work, version, file, excerpt, purpose, recipient, or project does not apply to another.

Removal, Correction, and Protection of Rights

Where Unreleased Materials have been accessed, used, disclosed, registered, claimed, or distributed without authorisation, The Sanctuary of Fragility or a party authorised to act within the specific scope of written authority may, where appropriate:

𑇐 request that the activity stop;

𑇐 request deletion, removal, return, or destruction of materials and copies;

𑇐 request correction of attribution, metadata, registration, ownership, or affiliation;

𑇐 request preservation of relevant evidence;

𑇐 issue a public clarification;

𑇐 contact a platform, distributor, publisher, administrator, service provider, employer, institution, advertiser, sponsor, or other relevant party;

𑇐 dispute or challenge an unauthorised registration, claim, release, profile, or rights-management asset;

𑇐 request restriction, removal, suspension, demonetisation, or other corrective action where an appropriate basis exists; or

𑇐 pursue another lawful and proportionate remedy.

The Sanctuary of Fragility is not required to provide advance private notice before taking action where the disclosure or use appears deliberate, fraudulent, harmful, urgent, unlawful, or likely to interfere with an official release, collaboration, registration, or rights-management process.

A delay or decision not to act in one case does not grant permission, waive rights, approve the use, or prevent later action.

Relationship with Other Sections

This section applies separately from and more broadly than the Cover and Adaptation Policy.

The permissions available for covers, fan works, platform uses, translations, adaptations, or other public uses do not apply to Unreleased Materials unless this Rights and Usage Policy or a separate written agreement expressly states otherwise.

Where another section permits use of a released work, that permission does not extend to unreleased drafts, files, versions, source materials, production assets, private information, or related project elements.

Nothing in this section limits any use that applicable law independently permits without authorisation. However, the existence of such a legal right does not mean that The Sanctuary of Fragility has approved, endorsed, participated in, or agreed with the use.

Fan Art and Non-Commercial Visual Contributions

The Sanctuary of Fragility welcomes respectful, non-commercial fan art and visual contributions inspired by the project. Fan art is understood as a personal creative response by the person who creates it, not as official The Sanctuary of Fragility material unless The Sanctuary of Fragility expressly states otherwise in writing.

The creator of fan art or a non-commercial visual contribution keeps the rights in the original expression that they personally create in their own work, to the extent recognised by applicable law. The Sanctuary of Fragility does not claim ownership of fan art merely because it is inspired by the project, shared with the project, tagged to the project, submitted to the project, acknowledged by the project, or reposted by the project.

The Sanctuary of Fragility may, at its discretion, like, comment on, share, repost, display, or acknowledge fan art or non-commercial visual contributions in order to appreciate, credit, or respond to the creator’s work. When reasonably possible, The Sanctuary of Fragility will try to credit the creator by the name, username, handle, or link reasonably available from the original post or submission.

Any like, comment, share, repost, display, acknowledgement, or credit by The Sanctuary of Fragility does not transfer ownership of the fan art to The Sanctuary of Fragility, does not make the fan art official project material, does not create an official collaboration, does not grant The Sanctuary of Fragility unlimited rights to use the work, and does not waive the creator’s rights in their own original contribution.

If The Sanctuary of Fragility wishes to use fan art or a non-commercial visual contribution beyond ordinary appreciation, credit, social-media sharing, reposting, or acknowledgement, including for official project materials, merchandise, cover art, music video material, podcast material, website material, paid promotion, commercial use, or other controlled project use, The Sanctuary of Fragility will seek separate permission or a separate agreement where appropriate.

At the same time, creating fan art or a visual contribution does not give the creator ownership of The Sanctuary of Fragility, its project name, official identity, lyrics, audio, music releases, podcast releases, written materials, official artwork, characters, concepts, policies, captions, statements, or other materials controlled by The Sanctuary of Fragility.

Fan art and non-commercial visual contributions should be clearly presented as unofficial fan work, unless The Sanctuary of Fragility has expressly approved a different status in writing. The creator must not suggest that the work is created by, commissioned by, approved by, endorsed by, sponsored by, affiliated with, or officially connected to The Sanctuary of Fragility unless prior written permission has been granted.

Fan art and non-commercial visual contributions may be shared on social-media platforms or personal non-commercial pages, provided that the work is not sold, licensed, registered, minted, used for advertising, used for brand promotion, used as merchandise, used as part of a commercial product or service, or used in a way that falsely suggests official approval, endorsement, collaboration, sponsorship, or ownership by The Sanctuary of Fragility.

Fan art and non-commercial visual contributions must not be used in connection with political campaigning, partisan promotion, religious promotion, cult promotion, propaganda, hate, harassment, discrimination, dehumanisation, glorification of violence, incitement, exploitation of vulnerable people, unlawful activity, misleading claims, reputation laundering, or any context that falsely suggests that The Sanctuary of Fragility supports, endorses, participates in, or is responsible for the creator’s message, belief, organisation, campaign, product, service, or conduct.

The Sanctuary of Fragility reserves the right to request correction, clarification, removal, credit changes, label changes, or other reasonable action where fan art or a visual contribution creates confusion, misrepresents its relationship to The Sanctuary of Fragility, violates this policy, infringes rights, uses official materials without permission, or is connected to harmful, misleading, commercial, or prohibited contexts.

All rights not expressly granted are reserved.

Cover and Adaptation Policy

1. General Covers

For the purposes of this policy, a “general cover” means a newly performed and newly recorded version of an officially released song by The Sanctuary of Fragility.

A general cover must use newly created or lawfully obtained vocals, performances, and musical accompaniment. It must not use, extract, sample, copy, edit, separate, reproduce, or incorporate any original audio controlled by The Sanctuary of Fragility.

A general cover should retain the recognisable principal melody and the essential identity of the relevant song. Reasonable changes to key, tempo, instrumentation, genre, arrangement, vocal approach, and performance style are permitted as described in Section 2.

The use of lyrics, official language versions, unofficial fan translations, multilingual covers, and lyric displays is governed by the relevant sections of this policy.

A general cover must not be presented as:

𑇐 an official release by The Sanctuary of Fragility;

𑇐an approved or authorised version;

𑇐 a commissioned work;

𑇐 an official collaboration;

𑇐 a recording performed, produced, supervised, or released by The Sanctuary of Fragility; or

𑇐 a work endorsed or sponsored by The Sanctuary of Fragility.

Subject to this policy, applicable law, platform rules, licensing requirements, rights-administration systems, and third-party rights, The Sanctuary of Fragility does not object to compliant general covers being published through video, audio, streaming, social-media, or user-generated-content platforms.

Unless another exception in this policy applies, a person publishing a planned general cover must submit the applicable General Cover Notification Form before publication.

The form is a notification rather than a request for individual artistic approval. A compliant general cover may proceed after submission without waiting for a reply from The Sanctuary of Fragility.

Submission of a form does not mean that The Sanctuary of Fragility has:

𑇐 reviewed the completed cover;

𑇐 approved its artistic interpretation;

𑇐 confirmed that it complies with all laws or platform rules;

𑇐 cleared any third-party materials used in the cover;

𑇐 endorsed its surrounding content or message; or

𑇐 entered into an official collaboration.

The cover artist remains responsible for the cover, its performance, recording, accompaniment, publication, surrounding content, licences, legal compliance, platform compliance, and any third-party materials used.

2. Reasonable Performance Adjustments

A general cover may include reasonable performance adjustments that allow the cover artist to perform the song naturally in their own voice and style.

Reasonable adjustments may include changes to:

𑇐 musical key;

𑇐 tempo;

𑇐 instrumentation;

𑇐 genre or general arrangement;

𑇐vocal range;

𑇐 vocal tone, technique, phrasing, or performance style;

𑇐 the length of instrumental introductions, transitions, or endings;

𑇐 repeated sections, where the song’s essential structure and meaning remain reasonably recognisable; and

𑇐minor wording, pronunciation, grammatical form, pronouns, or vocal phrasing where reasonably necessary for natural performance, language use, vocal ability, or the performer’s identity.

These adjustments must not be used to materially rewrite the lyrics, substitute a different message, create a substantially new narrative, reverse the meaning of the song, or falsely present a materially altered work as the official version.

A reasonable performance adjustment must not:

𑇐 replace the recognisable principal melody with a substantially new melody;

𑇐 materially rewrite, add to, or remove the lyrics;

𑇐 combine unrelated lyrics or sections in a misleading way;

𑇐 create a new translation and present it as official;

𑇐 materially distort the emotional progression, imagery, narrative, or intended meaning of the song; or

𑇐 create confusion about whether the work is an official version by The Sanctuary of Fragility.

Changes that go beyond reasonable performance adjustments may constitute an adaptation and may be governed by the section on adaptations requiring prior written permission.

Nothing in this section requires a performer to imitate the vocal tone, gender, identity, accent, vocal characteristics, or personal background of any voice appearing in an official recording.

A performer may interpret and perform a song through their own voice, identity, and artistic style, provided that the performance remains reasonably recognisable as a cover and does not materially misrepresent the song or its relationship to The Sanctuary of Fragility.

3. Brief, Incidental, Casual, and Spontaneous Performances

A brief, incidental, casual, or spontaneous performance does not require submission of the General Cover Notification Form.

This exception may include:

𑇐 singing a short excerpt in a personal post;

𑇐 casually singing part of a song during a livestream;

𑇐 performing one verse, chorus, or another limited passage;

𑇐 participating in a duet, stitch, challenge, response, reaction, or similar platform interaction;

𑇐 singing part of a song in conversation, rehearsal, practice, or an informal gathering; or

𑇐sharing a short excerpt from a cover that otherwise complies with this policy.

A person does not need to perform the entire song. They may perform only the part they wish to sing.

However, this exception does not automatically apply where the performance is developed or presented as:

𑇐 a formally produced or planned full cover release;

𑇐 a distributor release;

𑇐 an advertisement or branded campaign;

𑇐 sponsored content created specifically around the song;

𑇐 a paid or separately licensed production;

𑇐 an official or authorised version;

𑇐 a substantial musical or lyrical adaptation; or

𑇐 another restricted or prohibited use under this policy.

The absence of a notification requirement does not mean that The Sanctuary of Fragility has reviewed, approved, endorsed, supervised, participated in, or accepted responsibility for the performance, its interpretation, its surrounding content, or the views and conduct of the performer.

If a brief or spontaneous performance is later expanded, formally recorded, commercially released, distributed, monetised through a separate commercial arrangement, incorporated into advertising, or developed into another form of use, the requirements applicable to that later use must be followed.

Any use of official lyrics, unofficial translations, mixed-language versions, original audio, third-party accompaniment, or platform music features remains subject to the relevant sections of this policy.

4. Live Covers

An ordinary live performance of a general cover may proceed without submission of the General Cover Notification Form and without individual artistic approval from The Sanctuary of Fragility.

For the purposes of this section, a live cover may include a performance at:

𑇐 a concert;

𑇐 a music venue;

𑇐 a festival;

𑇐 a community or private event;

𑇐 a livestream;

𑇐 an open-mic event;

𑇐 a rehearsal or informal performance open to an audience; or

𑇐 another comparable live-performance setting.

A live cover must not be presented as an official performance, commissioned performance, sponsored event, approved event, or official collaboration involving The Sanctuary of Fragility unless that status has been expressly confirmed in writing.

No original audio controlled by The Sanctuary of Fragility may be used as a backing track, accompaniment, isolated vocal, instrumental, stem, sample, playback file, or other performance audio unless expressly authorised in writing by The Sanctuary of Fragility or used through an official platform feature within the rights granted by that platform.

The performer, organiser, venue, promoter, broadcaster, livestreaming service, platform, or other responsible party remains responsible for:

𑇐 public-performance licences;

𑇐 venue permissions;

𑇐 music-licensing obligations;

𑇐 royalty obligations;

𑇐 livestreaming and broadcasting permissions;

𑇐 platform compliance;

𑇐 recording permissions;

𑇐 performer and participant permissions;

𑇐 third-party accompaniment and materials; and

𑇐 all other applicable legal, contractual, and administrative requirements.

This policy does not provide or replace any licence, royalty payment, platform permission, venue authorisation, third-party clearance, or legal requirement applicable to a live performance.

A live cover may be recorded, streamed, archived, or reposted only to the extent permitted by applicable law, the venue, the platform, relevant licences, participating performers, third-party rights holders, and this policy.

If a live performance is later distributed or used as:

𑇐 a commercial audio release;

𑇐 a commercial audiovisual release;

𑇐 an album or single;

𑇐 a distributor release;

𑇐 a paid recording;

𑇐 an advertisement;

𑇐 sponsored or branded content; or

𑇐 another separately regulated use,

the requirements applicable to that later use must also be followed.

The Sanctuary of Fragility may view, acknowledge, like, share, or repost a live cover. Such interaction does not make the performance official, transfer ownership, create an official collaboration, approve all surrounding content, or grant permission for further use beyond the rights otherwise available under this policy.

5. Ordinary Platform Monetisation and Commercial Uses

A cover that complies with this policy may use the ordinary monetisation features made available by the relevant platform, subject to applicable law, platform rules, licensing requirements, rights-administration systems, and third-party rights.

For the purposes of this section, “ordinary platform monetisation” means monetisation arising through the platform’s standard features in connection with the cover artist’s own cover content, such as:

𑇐 advertising revenue;

𑇐 creator-revenue programmes;

𑇐 subscription-based revenue;

𑇐 platform revenue sharing; or

𑇐 similar standard monetisation systems provided directly by the platform.

The Sanctuary of Fragility does not object to a compliant cover artist using ordinary platform monetisation solely because the cover generates revenue.

Ordinary platform monetisation does not, by itself, make a cover a sponsored, branded, advertising, promotional, commissioned, or officially collaborative use.

However, permission or non-objection under this policy does not mean that the song, lyrics, composition, official lyrical adaptations, or other protected materials are free of copyright, free to use without rights administration, or exempt from royalties, revenue sharing, licensing requirements, platform claims, or other lawful rights-management processes.

A cover and its monetisation may be subject to:

𑇐 copyright royalties;

𑇐 publishing royalties;

𑇐 revenue sharing;

𑇐 platform-based rights claims;

𑇐 Content ID or similar identification systems;

𑇐 licensing requirements;

𑇐 rights administration;

𑇐 collection by a publisher administrator, rights administrator, collecting organisation, platform, licensing service, or another authorised party; and

𑇐 other lawful payments, deductions, claims, restrictions, or administrative processes.

The applicable treatment may vary according to the platform, territory, account type, distributor, licence, rights-management arrangement, applicable law, and the rights involved.

The Sanctuary of Fragility does not guarantee that:

𑇐 a cover will be eligible for monetisation;

𑇐 the cover artist will retain all revenue;

𑇐 a platform will continue to allow monetisation;

𑇐 no copyright claim, royalty collection, revenue share, deduction, restriction, or removal will occur; or

𑇐 the cover will be treated in the same way across different platforms or territories.

The cover artist remains responsible for:

𑇐 understanding and complying with the platform’s monetisation rules;

𑇐 obtaining any licence, permission, or clearance required for the cover;

𑇐 resolving claims relating to their own recording, performance, accompaniment, artwork, video, or other materials;

𑇐 complying with applicable law and third-party rights; and

𑇐 providing accurate information to platforms, distributors, licensing services, and rights-management systems.

Sponsored, Branded, Advertising, and Promotional Uses

Sponsored, branded, advertising, campaign, commissioned, and promotional uses are not considered ordinary platform monetisation under this policy.

Prior written permission from The Sanctuary of Fragility is required before a cover, lyrics, song, project name, or other material controlled by The Sanctuary of Fragility is used in connection with:

𑇐 sponsored content;

𑇐 paid partnerships;

𑇐 brand collaborations;

𑇐 commissioned promotional content;

𑇐 product placement where the song or lyrics form a meaningful part of the promotion;

𑇐 advertisements;

𑇐 trailers or promotional materials;

𑇐 commercial or promotional campaigns;

𑇐 fundraising campaigns or donation drives;

𑇐 the promotion of a product, service, business, clinic, institution, organisation, event, public figure, charitable activity, cause, or other commercial or organised third-party project, subject always to Section 19;

𑇐 the sale or promotion of goods, services, tickets, subscriptions, memberships, programmes, or campaign materials; or

𑇐 any other use that may reasonably create a commercial, organisational, institutional, reputational, or promotional association with The Sanctuary of Fragility.

A cover does not become ordinary platform monetisation merely because it is uploaded to a platform that offers standard monetisation features.

Where the cover is created for, funded by, commissioned by, sponsored by, or materially connected to a brand, advertiser, business, organisation, campaign, public figure, event, product, service, or other third party, it is a separately regulated use even if the platform also pays ordinary advertising or creator revenue.

Uses addressed by Section 19 are not eligible for permission or official collaboration under this policy merely because they are sponsored, commercial, promotional, submitted through a form, or offered on favourable financial terms.

In particular, this section does not create a route to obtain permission for political campaigning, partisan promotion, religious recruitment or promotion, ideological propaganda, hate, discrimination, dehumanisation, targeted harassment, incitement, glorification of violence, violent extremism, terrorism, or other uses addressed by Section 19.

Permission from the cover artist, performer, producer, owner of the newly recorded cover master, platform, advertiser, sponsor, brand, organisation, or other third party does not replace permission from The Sanctuary of Fragility for any lyrics, composition rights, official lyrical adaptations, project identity, official materials, or other rights owned, controlled, administered, or represented by The Sanctuary of Fragility.

A request concerning an otherwise eligible commercial, promotional, charitable, or organised use may be declined where the proposed use:

𑇐 is inconsistent with the identity, values, boundaries, independence, public position, or protective purpose of The Sanctuary of Fragility;

𑇐 may create confusion about official involvement;

𑇐 may create a misleading endorsement, sponsorship, partnership, or affiliation;

𑇐 may cause reputational harm;

𑇐 may exploit the emotional meaning, audience trust, or public identity of the project;

𑇐 may conflict with another release, collaboration, campaign, agreement, or project plan; or

𑇐 may otherwise adversely affect The Sanctuary of Fragility, its materials, its collaborators, or its audience.

Submission of a request does not create any right to proceed.

The proposed use must not begin, be announced as approved, or be presented as official unless and until:

𑇐 The Sanctuary of Fragility has granted prior written permission;

𑇐 the parties have agreed all necessary terms;

𑇐 any required licence, commission, collaboration, or other written agreement has been completed; and

𑇐 all other rights, permissions, clearances, and approvals have been obtained.

Permission for one sponsored, commercial, advertising, promotional, charitable, or organised use applies only to the specific project, parties, materials, platforms, territory, period, and purposes confirmed in writing.

It does not create permission for another campaign, product, service, release, organisation, sponsor, platform, territory, period, or use.

6. Required Credit

A cover must be presented clearly and reasonably as an unofficial cover.

Where sufficient space is available, the following full credit should be included:

Original song: “[Song Title]”

Original artist/project: The Sanctuary of Fragility

Original version: [Official link]

Cover performed by: [Cover Artist Name]

Notice: This is an unofficial cover. It is not an official release, collaboration, endorsement, sponsorship, or authorised representation of The Sanctuary of Fragility.

The notice means that the cover is independently created by the cover artist and is not being presented as a release, collaboration, endorsement, sponsorship, or official representation produced, approved, or authorised by The Sanctuary of Fragility.

Where a platform provides limited space, either of the following shortened formats may be used:

Short format A

Cover performed by: [Cover Artist Name]

Short format B

Original song: “[Song Title]”

Original artist/project: The Sanctuary of Fragility

Cover performed by: [Cover Artist Name]

The cover artist may choose whichever shortened format is more suitable for the platform. A direct official link is encouraged where links can be used appropriately, but it is not required where links are restricted, discouraged, impractical, or may interfere with the platform’s normal functionality or distribution.

The wording and formatting may be reasonably adapted to fit the platform, provided that the following remain sufficiently clear:

𑇐 the identity of the original song;

𑇐 The Sanctuary of Fragility as the original artist or project;

𑇐 the identity of the cover performer; and

𑇐 the unofficial and independent status of the cover.

Public-facing credit must use the full project name “The Sanctuary of Fragility.” The abbreviation “TSOF,” as defined elsewhere in this policy, is used only within this Rights and Usage Policy and should not normally be used as the public-facing project credit.

The cover artist must not use wording, metadata, artwork, titles, thumbnails, descriptions, tags, account presentation, or other materials that falsely suggest that the cover is:

𑇐 an official release;

𑇐 an official version;

𑇐 an approved or authorised adaptation;

𑇐 commissioned by The Sanctuary of Fragility;

𑇐 produced or supervised by The Sanctuary of Fragility;

𑇐 released in collaboration with The Sanctuary of Fragility;

𑇐 sponsored or endorsed by The Sanctuary of Fragility; or

𑇐 published through an official The Sanctuary of Fragility account or artist profile.

The shortened public credit does not replace any legal, licensing, distributor, publishing, songwriter, lyricist, ownership, rights-holder, royalty, or metadata information required by a platform, distributor, licensing service, publisher administrator, rights administrator, collecting organisation, or other relevant system.

Credit does not replace permission, a licence, royalty obligations, rights administration, revenue sharing, platform compliance, or any other requirement applicable to the cover or its use.

Providing credit does not give the cover artist ownership of the original song, lyrics, composition, official lyrical adaptations, project identity, official materials, or any other rights controlled by The Sanctuary of Fragility.

7. Official Language Versions and Official Lyrics

The Sanctuary of Fragility may release one or more official language versions of a song.

The original Thai lyrics are the source lyrics from which the project’s other official language versions may be developed. An official English version, or any other official language version released by The Sanctuary of Fragility, may involve both translation and lyrical adaptation.

Accordingly, official language versions should not necessarily be treated as word-for-word equivalents of one another. Differences may reflect deliberate creative decisions concerning:

𑇐 meaning and emphasis;

𑇐 emotional tone and progression;

𑇐 imagery, metaphor, and symbolism;

𑇐 cultural and linguistic context;

𑇐 rhythm, phrasing, rhyme, and singability;

𑇐 narrative perspective; and

𑇐 the overall identity and intended effect of the song.

For a cover using an official language version, the cover artist should use the official lyrics published or supplied by The Sanctuary of Fragility for that version.

Official lyrics must not be presented as corrected, improved, replaced, or superseded according to the cover artist’s personal preference.

Reasonable performance adjustments permitted under Section 2 do not make an altered lyric text an official version and must not be used to materially rewrite the song.

Where The Sanctuary of Fragility later publishes a correction, revision, replacement, or updated official version, the most recently identified official version should normally be used for new covers, unless The Sanctuary of Fragility states that an earlier version remains valid.

A language version becomes official only when it is published, supplied, adopted, or expressly confirmed in writing as official by The Sanctuary of Fragility.

The existence of a fan translation, machine translation, translated subtitle, cover adaptation, lyric interpretation, or third-party version does not make that version official.

Official language versions remain protected materials. Their publication does not place them in the public domain or grant unrestricted rights to reproduce, translate, adapt, distribute, register, monetise, or claim ownership over them.

8. Multilingual and Mixed-Language Covers

A cover may use more than one language or combine parts of different language versions. However, The Sanctuary of Fragility does not generally recommend mixing, alternating, combining, or rearranging separate official language versions without careful consideration.

Each official language version may be a distinct lyrical adaptation rather than a word-for-word substitute for another version. Combining them may alter or interrupt:

𑇐 the intended meaning;

𑇐 the emotional progression;

𑇐 the narrative structure;

𑇐 the relationship between metaphors and images;

𑇐 the point of view;

𑇐 the rhythm and lyrical flow; or

𑇐 the listener’s understanding of the song.

A multilingual or mixed-language cover must not be presented as an official bilingual, multilingual, translated, adapted, or approved version unless The Sanctuary of Fragility has expressly confirmed that status in writing.

Where a cover artist independently combines official language versions, the resulting combination remains the cover artist’s own unofficial interpretation. The Sanctuary of Fragility does not automatically review, approve, endorse, or accept responsibility for its accuracy, meaning, structure, or emotional effect.

The cover artist should make the unofficial nature of the mixed-language arrangement reasonably clear where the presentation could otherwise cause confusion.

If The Sanctuary of Fragility releases an official bilingual or multilingual version, that version may be covered under this policy as an official version, subject to any additional terms attached to that release.

Nothing in this section authorises the use of original audio, the creation of false official status, or any other use prohibited or separately regulated under this policy.

9. Unofficial Fan Translations

A person may create, discuss, display, perform, or use their own unofficial fan translation, subject to applicable law, platform rules, third-party rights, and the other provisions of this policy.

An unofficial fan translation does not require prior review or approval from The Sanctuary of Fragility.

The Sanctuary of Fragility does not undertake to review, correct, verify, approve, or authorise fan translations. The translator remains responsible for the language, meaning, interpretation, accuracy, cultural context, and presentation of the translation.

An unofficial fan translation must not be represented as:

𑇐 an official translation;

𑇐 an official lyrical adaptation;

𑇐 a translation published or supplied by The Sanctuary of Fragility;

𑇐 a version reviewed or corrected by The Sanctuary of Fragility;

𑇐 an approved or authorised translation;

𑇐 an endorsed interpretation; or

𑇐 a translation created in collaboration with The Sanctuary of Fragility.

Where reasonably possible, the unofficial status should be made clear in the title, description, caption, credits, accompanying text, or another visible part of the publication.

The following notice may be used:

Unofficial fan translation. Not reviewed, approved, or endorsed by The Sanctuary of Fragility.

The wording may be adapted where necessary, provided that it remains reasonably clear that the translation is unofficial and has not been reviewed, approved, or endorsed by The Sanctuary of Fragility.

If The Sanctuary of Fragility has announced or otherwise indicated that an official version in the relevant language is being prepared, users are encouraged to wait for the official version where practical.

An official version may differ substantially from a fan translation because it may involve lyrical adaptation, creative revision, emotional interpretation, rhythm, imagery, and other artistic decisions rather than direct word-for-word translation.

The official English version should not automatically be treated as the primary source for translation into a further language. Because the English version may itself be a lyrical adaptation of the original Thai lyrics, translating from the English version may carry forward or increase differences from the original meaning.

Where practical and linguistically possible, a person preparing a new fan translation is encouraged to consult the original Thai lyrics, together with any available official language versions and project explanations, rather than relying solely on the English version.

The Sanctuary of Fragility does not guarantee the accuracy of any unofficial fan translation and is not responsible for confusion, altered meaning, cultural misunderstanding, reputational effects, or other consequences arising from it.

Permission to create or identify an unofficial fan translation under this section does not grant unrestricted permission to reproduce or distribute the lyrics separately, use them commercially, create merchandise or independent text products, claim rights in the original lyrics, or present the translation as an official work.

10. Lyric Display and Separate Lyric Distribution

A cover artist may display the lyrics used in their cover as subtitles, captions, on-screen lyrics, or the principal visual component of a lyric-style cover video, provided that:

𑇐 the lyric display is directly connected to the cover artist’s own performance or newly recorded cover;

𑇐 the display complies with applicable law and platform rules;

𑇐 the lyrics are accurately identified as official or unofficial, as applicable;

𑇐 the display does not falsely suggest official release, approval, endorsement, or collaboration by The Sanctuary of Fragility; and

𑇐 all other applicable provisions of this policy are followed.

A cover video does not need to show the performer on screen. A lyric-style video using the cover artist’s own newly recorded performance may be treated in the same way as another cover format, subject to this policy.

Official lyrics and official lyrical adaptations remain protected by copyright and other applicable rights.

The display of lyrics in connection with a cover does not mean that the lyrics are free to use, free from rights administration, or exempt from:

𑇐 copyright royalties;

𑇐 publishing royalties;

𑇐 revenue sharing;

𑇐 platform-based claims;

𑇐 Content ID or similar systems;

𑇐 licensing requirements;

𑇐 collection by a publisher administrator, rights administrator, collecting organisation, platform, licensing service, or other authorised party; or

𑇐 other lawful rights-management processes.

The applicable treatment may vary by platform, territory, format, account type, licensing arrangement, rights administrator, and applicable law. The Sanctuary of Fragility does not guarantee that a lyric display will be free from claims, revenue sharing, royalty collection, restrictions, or other rights-administration action.

The limited ability to display lyrics in direct connection with a cover does not grant permission to reproduce, publish, distribute, sell, license, compile, scrape, extract, or otherwise make the lyrics available separately as:

𑇐 a downloadable lyric sheet;

𑇐 a standalone lyric video using an official The Sanctuary of Fragility recording;

𑇐 a lyric database or archive;

𑇐 a website or account primarily reproducing lyrics;

𑇐 a book, publication, booklet, or collection;

𑇐 a template or design product;

𑇐 a dataset or model-training resource;

𑇐 merchandise;

𑇐 a paid or commercial text product; or

𑇐 another independent distribution of the lyrics.

An unofficial fan translation may be displayed with a cover, but its unofficial status should be made reasonably clear in accordance with Section 9.

The display of lyrics does not grant ownership of the lyrics, the song, the official lyrical adaptations, or any other material controlled by The Sanctuary of Fragility.

All rights not expressly granted are reserved.

11. Original Audio Is Not Available for Third-Party Use

Except where expressly stated otherwise in writing by The Sanctuary of Fragility, original audio controlled by The Sanctuary of Fragility is not available for third-party use.

For the purposes of this policy, “original audio” includes, without limitation:

𑇐 official master recordings;

𑇐 instrumental recordings;

𑇐 backing tracks;

𑇐 karaoke or performance tracks;

𑇐 isolated vocals;

𑇐 stems and separated audio components;

𑇐 project audio files;

𑇐 demos, drafts, rough mixes, alternate versions, and unreleased recordings;

𑇐 audio outputs generated through SUNO or another music-generation service for The Sanctuary of Fragility;

𑇐 edited, mixed, mastered, processed, or otherwise modified audio files;

𑇐 excerpts, previews, snippets, teasers, and short audio clips;

𑇐 audio extracted, recorded, downloaded, copied, or captured from YouTube, SoundCloud, social-media platforms, distributor services, websites, podcasts, videos, livestreams, or other sources; and

𑇐 any other audio file or audio component created for, released by, controlled by, administered by, or expressly authorised for use by The Sanctuary of Fragility.

Third parties must not download, extract, copy, record, reproduce, separate, isolate, edit, modify, remix, sample, loop, incorporate, re-upload, redistribute, synchronise, perform over, sing over, use as accompaniment, create derivative audio from, register, monetise, submit to Content ID, or otherwise use original audio unless prior written permission has been expressly granted by The Sanctuary of Fragility.

The prohibition applies whether the proposed use involves the full recording or only a short, altered, background, low-volume, partially obscured, or isolated portion of the audio.

The availability of an official recording for listening, streaming, purchasing, downloading through an authorised service, embedding, sharing, or viewing does not grant permission to reuse the audio in a cover, remix, video, podcast, performance, advertisement, project, product, service, dataset, model-training process, or other separate work.

Use of a track through an official platform music library or another authorised platform-provided audio feature is governed by the section on official platform music libraries. Such platform-based use does not grant permission to remove the audio from the feature, obtain the underlying file, transfer it to another platform, edit it outside the authorised feature, or reuse it beyond the rights expressly provided by that platform.

The Sanctuary of Fragility does not accept third-party requests to use original audio through the general cover-notification process. A person wishing to create a cover must record or lawfully obtain new vocals, performances, and accompaniment as provided elsewhere in this policy.

This restriction is intended in part to reduce conflicting ownership claims, Content ID conflicts, monetisation disputes, unauthorised derivative recordings, uncertainty relating to AI-generated audio, and interference with the ability of The Sanctuary of Fragility to publish, distribute, monetise, identify, administer, or otherwise use its own recordings.

Nothing in this section restricts the use of original audio by:

𑇐 The Sanctuary of Fragility itself; or

𑇐 a collaborator, contractor, representative, administrator, distributor, platform, service provider, or other person or entity expressly authorised in writing by The Sanctuary of Fragility,

provided that such use remains within the specific purpose, material, platform, territory, period, and other limits of the written authorisation.

Any official human-performed version, commissioned version, collaborative recording, or future recording associated with The Sanctuary of Fragility is also covered by this section unless separate written terms attached to that particular work expressly provide otherwise.

12. Independently Created or Lawfully Obtained Accompaniment

A cover artist must create, perform, commission, or lawfully obtain the musical accompaniment used in their cover independently from The Sanctuary of Fragility.

Acceptable sources of accompaniment may include:

𑇐 accompaniment created and performed by the cover artist;

𑇐 accompaniment performed by musicians working with the cover artist;

𑇐 a newly commissioned arrangement or recording;

𑇐 a backing track obtained from a provider under a valid licence;

𑇐 lawfully licensed samples, loops, virtual instruments, or production resources; or

𑇐 accompaniment created with software, digital tools, or AI assistance in accordance with Section 13.

The cover artist is solely responsible for determining whether they have the necessary rights to record, reproduce, edit, distribute, monetise, publicly perform, synchronise, or otherwise use the accompaniment and every third-party element included in it.

The cover artist must comply with all applicable:

𑇐 licences and service terms;

𑇐 payment and subscription requirements;

𑇐 attribution requirements;

𑇐 commercial-use restrictions;

𑇐 territory and platform restrictions;

𑇐 sample and loop licences;

𑇐 performer and producer agreements;

𑇐 distributor requirements;

𑇐 platform rules; and

𑇐 applicable laws.

The Sanctuary of Fragility does not inspect, approve, license, clear, guarantee, or accept responsibility for accompaniment, backing tracks, samples, loops, software outputs, performances, production services, or other materials supplied or controlled by third parties.

Permission, non-objection, receipt of a notification form, acknowledgement, sharing, or any other communication from The Sanctuary of Fragility does not grant or confirm rights in any accompaniment or third-party material used by the cover artist.

A person who creates or commissions new accompaniment for a cover may hold rights in their newly created recording, performance, production, or arrangement to the extent recognised by applicable law and their agreements. Those rights do not include ownership of the original lyrics, song, official lyrical adaptations, project identity, or other rights controlled by The Sanctuary of Fragility.

The accompaniment must not incorporate original audio controlled by The Sanctuary of Fragility unless an express written exception has been granted under Section 11.

If a provider, musician, producer, software service, AI service, or other third party later makes a claim concerning the accompaniment, the cover artist remains responsible for resolving that claim and for any resulting restriction, payment, removal, revenue adjustment, or dispute.

13. AI-Assisted Accompaniment and Synthetic Voices

A cover may use accompaniment created with the assistance of an AI service, music-generation service, software tool, virtual instrument, voice-processing tool, or similar technology, provided that the use complies with this policy and all applicable laws, licences, service terms, and third-party rights.

The person using the technology is solely responsible for confirming that the applicable service or tool permits the intended:

𑇐 creation;

𑇐 commercial or non-commercial use;

𑇐 recording;

𑇐 editing;

𑇐 distribution;

𑇐 monetisation;

𑇐 public performance;

𑇐 synchronisation;

𑇐 platform upload; and

𑇐 other exploitation of the resulting material.

Use of an AI or software tool does not transfer responsibility for the resulting cover to The Sanctuary of Fragility. The cover artist remains responsible for the prompts, instructions, source materials, uploaded materials, generated outputs, selected outputs, editing, performance, publication, claims, disclosures, and surrounding content associated with their cover.

AI-assisted accompaniment must not include, reproduce, extract, transform, or derive from original audio controlled by The Sanctuary of Fragility unless expressly authorised in writing.

A synthetic, cloned, converted, imitated, or AI-generated voice must not be used to impersonate or misleadingly imitate:

𑇐 an identifiable real person;

𑇐 an artist, singer, performer, actor, public figure, or private individual;

𑇐 a collaborator associated with The Sanctuary of Fragility;

𑇐 the human creator behind The Sanctuary of Fragility; or

𑇐 a voice appearing in an official The Sanctuary of Fragility release,

unless all required permissions and rights have been obtained and the use does not create a false or misleading association with The Sanctuary of Fragility.

A cover using a synthetic or AI-generated voice must not be presented as:

𑇐 an official The Sanctuary of Fragility vocal;

𑇐 a leaked, unreleased, restored, or alternate official recording;

𑇐 a performance by a real person who did not perform it;

𑇐 a commissioned or approved synthetic performance;

𑇐 an official human-performed version;

𑇐 an official collaboration; or

𑇐 a recording produced, supervised, endorsed, or authorised by The Sanctuary of Fragility,

unless that status has been expressly confirmed in writing.

Where reasonably necessary to prevent confusion, the use of a synthetic or AI-generated voice should be disclosed clearly in the title, description, credits, accompanying text, or another visible part of the publication.

The Sanctuary of Fragility does not guarantee that an AI-generated or software-generated output is copyright-protected, non-infringing, unique, eligible for commercial use, accepted by a distributor, eligible for monetisation, or free from platform claims or third-party disputes.

The cover artist must not register, claim, monetise, or administer an AI-assisted cover in a way that:

𑇐 claims ownership of the original song, lyrics, or official lyrical adaptations;

𑇐 prevents The Sanctuary of Fragility from using or administering its own work;

𑇐 creates a conflicting Content ID or similar rights claim;

𑇐 falsely attributes AI-generated material to The Sanctuary of Fragility; or

𑇐 grants a platform, distributor, service, or third party rights beyond those the cover artist lawfully holds.

The Sanctuary of Fragility may request correction, clarification, revised disclosure, removal of misleading attribution, or other reasonable action where an AI-assisted cover or synthetic voice creates confusion, falsely suggests official involvement, infringes rights, impersonates a person, or interferes with the rights or activities of The Sanctuary of Fragility.

14. Covers Distributed Through a Music Distributor

A cover artist who intends to distribute a cover through a music distributor, digital music service, record label, distribution platform, or comparable release service must submit the Metadata Request Form before submitting the release to the distributor.

A distributor release is different from an ordinary online cover that uses only the platform’s standard monetisation features. Distribution may involve formal release metadata, licensing processes, publishing administration, royalty allocation, revenue sharing, rights identification, and delivery to multiple digital music services or territories.

For this reason, the General Cover Notification Form is not sufficient for a distributor release.

The Metadata Request Form serves two principal purposes:

1. to notify The Sanctuary of Fragility that the cover artist intends to distribute a cover through a distributor; and

2. to request and confirm the rights and metadata information necessary for the proposed release.

The cover artist must wait for a response from The Sanctuary of Fragility and must receive confirmation of the relevant metadata before submitting the release to the distributor.

The cover artist must provide sufficient information about the proposed release, including where applicable:

𑇐 the original song being covered;

𑇐 the language version being used;

𑇐 the cover artist’s name;

𑇐 the proposed release title;

𑇐 the distributor or distribution service;

𑇐 the intended platforms or stores;

𑇐 the intended release territories;

𑇐 the intended release date;

𑇐 whether the release will be monetised;

𑇐 whether the distributor offers or requires cover-song licensing;

𑇐 whether Content ID, audio fingerprinting, social-media monetisation, or similar rights-management services will be enabled; and

𑇐 any other information reasonably necessary to identify and assess the proposed release.

The Sanctuary of Fragility may provide or confirm information relating to the original song, lyrics, composition, songwriters, lyricists, publishers, publisher administrators, rights administrators, rights holders, identifiers, or other relevant rights metadata.

The information required may vary according to the distributor, territory, platform, licence, rights-administration arrangement, and applicable law. If additional information or discussion is necessary, the release must not be submitted until the relevant matters have been clarified.

Confirmation of metadata does not mean that The Sanctuary of Fragility has:

𑇐 reviewed or approved the completed recording;

𑇐 approved the artistic interpretation;

𑇐 guaranteed that the release qualifies as a lawful cover in every territory;

𑇐 provided every licence required by the distributor or applicable law;

𑇐 approved Content ID or another automated rights-claiming service;

𑇐 agreed to a particular revenue-sharing arrangement unless expressly confirmed in writing;

𑇐 endorsed the cover artist, distributor, or release; or

𑇐 entered into an official collaboration.

The cover artist remains responsible for obtaining and maintaining all licences, permissions, registrations, subscriptions, payments, and clearances required for the release.

The cover artist is also responsible for complying with the rules and procedures of the selected distributor, digital music services, collecting organisations, licensing services, publisher administrators, rights administrators, and other relevant parties.

A distributor release must use a newly recorded cover master created or lawfully controlled by the cover artist. It must not contain original audio controlled by The Sanctuary of Fragility unless separate written permission has been expressly granted.

A standard cover licence, distributor cover service, or metadata confirmation does not authorise:

𑇐 a material rewrite of the lyrics;

𑇐 a substantial musical or lyrical adaptation;

𑇐 the release of an unofficial translation as an official version;

𑇐 the use, sampling, remixing, or extraction of original audio;

𑇐 sponsored, branded, advertising, campaign, or promotional use;

𑇐 a false claim of official release, approval, endorsement, or collaboration; or

𑇐 any use outside the rights actually granted by the relevant licence, applicable law, and this policy.

Where the proposed release includes a substantial adaptation, commercial association, official collaboration, original audio, or another special use, the cover artist must submit the Collaboration, Commercial Use, and Special Permission Enquiry Form and must not proceed until separate written permission and any required agreement have been completed.

The Sanctuary of Fragility does not guarantee that any distributor, platform, licensing service, or rights-management system will accept, publish, monetise, retain, or continue carrying the release.

15. Distributor and Rights Metadata

A cover distributed through a music distributor or comparable release service must be submitted with complete, accurate, current, and non-misleading metadata.

The cover artist must not guess, invent, alter, or independently assign information concerning the original song, songwriters, lyricists, composers, publishers, publisher administrators, rights administrators, rights holders, ownership shares, or other rights-related data.

Information relating to The Sanctuary of Fragility or the underlying song must be obtained or confirmed through the Metadata Request Form before the release is submitted.

Where the distributor or rights system later requests additional information, the cover artist must contact The Sanctuary of Fragility again rather than completing uncertain information without confirmation.

The cover artist must clearly identify the release as a cover wherever the distributor, licensing service, platform, or rights-management system requires that information.

Public-facing credit under Section 6 does not replace the legal, publishing, ownership, royalty, songwriter, lyricist, composer, rights-holder, identifier, or other metadata required by a distributor or rights system.

The cover artist may identify themselves and their lawful collaborators as the performers, producers, arrangers, musicians, or owners of the newly recorded cover master, as applicable.

However, the cover artist must not:

𑇐 identify The Sanctuary of Fragility as the performer of the cover;

𑇐 list The Sanctuary of Fragility as a primary artist, featured artist, producer, remixer, label, distributor, or collaborator unless expressly authorised in writing;

𑇐 submit or map the cover to an official artist profile belonging to The Sanctuary of Fragility;

𑇐 identify the cover as an official recording, official version, or official collaboration;

𑇐 claim that the cover artist wrote or owns the original lyrics or composition;

𑇐 remove, replace, conceal, or falsify required songwriter, lyricist, composer, publisher, administrator, or rights-holder information;

𑇐 submit ownership percentages, publishing information, or rights information that has not been confirmed or lawfully obtained;

𑇐 use the project name, artwork, logos, catalogue information, release identifiers, or official materials in a misleading manner; or

𑇐 enter metadata that suggests an approval, commission, endorsement, sponsorship, or relationship that does not exist.

Rights in the newly recorded cover master, performance, production, or independently created arrangement do not include ownership of the underlying song, original lyrics, composition, official lyrical adaptations, project identity, or other materials controlled by The Sanctuary of Fragility.

Any metadata supplied or confirmed by The Sanctuary of Fragility must be used only for the specific release, language version, distributor, and proposed use identified in the request, unless The Sanctuary of Fragility confirms otherwise.

The cover artist must not publish, disclose, circulate, reuse, or retain non-public legal, administrative, contractual, account, ownership, or rights-management information beyond what is reasonably necessary for the relevant release.

If the proposed release materially changes after metadata has been confirmed, including a change to the song, language version, release title, cover artist, distributor, territory, format, commercial arrangement, Content ID status, or intended use, the cover artist must request confirmation again where the change affects the previously supplied information.

The cover artist is responsible for reviewing the release after delivery and taking reasonable steps to correct:

𑇐 inaccurate credits;

𑇐 incorrect artist-profile mapping;

𑇐 missing or incorrect songwriter or lyricist information;

𑇐 incorrect publishing or rights information;

𑇐 inaccurate ownership claims;

𑇐 incorrect language or version descriptions; and

𑇐 other material metadata errors.

If The Sanctuary of Fragility identifies materially inaccurate, incomplete, or misleading metadata, it may request correction, clarification, redelivery, profile separation, claim release, or removal through the cover artist, distributor, platform, administrator, or another appropriate channel.

The Sanctuary of Fragility may provide necessary non-public information through a private or administrative process. This policy does not require the publication of private legal names, confidential agreements, account details, ownership records, or other non-public information on the public website.

16. Content ID, Monetisation Claims, and Conflicting Rights Claims

A cover artist may hold rights in the newly recorded cover master, their own performance, production, and independently created elements to the extent recognised by applicable law and the agreements governing the recording.

Those rights do not include ownership of the original song, lyrics, composition, official lyrical adaptations, project identity, or other materials controlled by The Sanctuary of Fragility.

The cover artist must disclose through the Metadata Request Form whether they intend to enable or use:

𑇐 Content ID;

𑇐 audio fingerprinting;

𑇐 social-media rights management;

𑇐 automated monetisation claims;

𑇐 catalogue-protection services;

𑇐 reference-file delivery;

𑇐 automated blocking or enforcement tools; or

𑇐 another comparable rights-identification or claiming system.

Providing or confirming metadata does not automatically authorise the use of Content ID or another automated claiming system.

Before enabling such a service, the cover artist must confirm that:

𑇐 the distributor or platform permits a cover recording to be enrolled;

𑇐 the applicable licence and service terms permit enrolment;

𑇐 the cover master is eligible for the relevant system;

𑇐 the reference file contains no original audio controlled by The Sanctuary of Fragility;

𑇐 the claim will be limited to rights lawfully held in the newly recorded cover master; and

𑇐 the system will not improperly claim the underlying composition, official recordings, or other lawful cover versions.

The cover artist must not submit, register, administer, or permit a cover to be used in a rights-identification or claiming system in a manner that:

𑇐 claims ownership of the original song, lyrics, or composition;

𑇐 claims exclusive rights in the underlying song;

𑇐 claims an official recording or original audio controlled by The Sanctuary of Fragility;

𑇐 blocks, mutes, removes, redirects revenue from, or otherwise interferes with an official release of The Sanctuary of Fragility;

𑇐 prevents The Sanctuary of Fragility from uploading, distributing, monetising, administering, or using its own work;

𑇐 claims another lawful cover merely because it uses the same underlying song;

𑇐 claims an official language version or an unofficial fan translation beyond the rights actually held;

𑇐 conflicts with a lawful claim or administration by a publisher administrator, rights administrator, collecting organisation, distributor, platform, licensing service, or another party authorised to act for The Sanctuary of Fragility; or

𑇐 represents the cover artist as the exclusive owner or administrator of rights that belong to The Sanctuary of Fragility or another rights holder.

The cover artist remains responsible for claims generated by:

𑇐 the cover artist;

𑇐 their distributor;

𑇐 their label;

𑇐 their publisher or administrator;

𑇐 a platform;

𑇐 a rights-management service;

𑇐 a service provider; or

𑇐 another party acting on their behalf.

If a claim is inaccurate, excessive, conflicting, or misleading, the cover artist must take reasonable and timely action to:

𑇐 investigate the claim;

𑇐 release or withdraw any part of the claim that exceeds the rights lawfully held;

𑇐 instruct the distributor, platform, administrator, or service provider to correct the claim;

𑇐 correct inaccurate ownership or rights metadata;

𑇐 remove an ineligible reference file where necessary;

𑇐 cooperate with affected parties in resolving the conflict; and

𑇐 prevent the same improper claim from being repeatedly applied.

The cover artist must not knowingly dispute or obstruct a lawful claim solely because it reduces, redirects, or affects revenue from the cover.

A distributor release may legitimately be subject to:

𑇐 composition or publishing claims;

𑇐 mechanical or other copyright royalties;

𑇐 revenue sharing;

𑇐 licensing deductions;

𑇐 platform monetisation adjustments;

𑇐 rights administration;

𑇐 collection by a publisher administrator, rights administrator, collecting organisation, platform, licensing service, or another authorised party; and

𑇐 other lawful rights-management processes.

The exact treatment may depend on the distributor, platform, territory, licence, agreement, rights system, and applicable law. Where the distributor’s revenue-sharing or licensing process requires further agreement or clarification, the matter may be discussed following submission of the Metadata Request Form.

A lawful claim concerning the underlying song or publishing rights does not transfer ownership of the cover artist’s newly recorded master to The Sanctuary of Fragility.

Likewise, ownership or control of the newly recorded cover master does not transfer ownership of the underlying song, lyrics, composition, or publishing rights to the cover artist.

The absence of an automated claim does not mean that the underlying work is free to use, that no royalties are due, that permission has been granted, or that the cover artist owns the underlying rights.

Similarly, the existence of an automated claim does not by itself conclusively determine legal ownership, permission, official status, endorsement, or the complete scope of any party’s rights.

Where a claim interferes with the official releases, rights, revenue, distribution, administration, or activities of The Sanctuary of Fragility, The Sanctuary of Fragility or a party authorised to act within the specific scope of written authority may request correction, release, exclusion, removal, dispute resolution, or other appropriate action through the relevant distributor, platform, administrator, service provider, or lawful process.

17. Adaptations Requiring Prior Written Permission

The Sanctuary of Fragility distinguishes between ordinary covers, unofficial non-commercial fan works, uses made through authorised platform features, distributor releases, and adaptations or special uses that require separate review and prior written permission.

Reasonable performance adjustments permitted under Section 2 do not require separate permission. Unofficial fan translations governed by Section 9 remain subject to the terms of that section and do not become official adaptations merely because they translate or interpret the lyrics.

An independently created, non-commercial fan adaptation may be shared without prior written permission where it:

𑇐 is created primarily for personal expression, creative exploration, education, discussion, or fan activity;

𑇐 is not sponsored, commissioned, monetised, sold, licensed, or otherwise used as part of a commercial activity;

𑇐 does not use original audio controlled by The Sanctuary of Fragility;

𑇐 does not falsely claim official status, approval, endorsement, sponsorship, or collaboration;

𑇐 does not materially misrepresent the involvement or position of The Sanctuary of Fragility; and

𑇐 otherwise complies with this policy, applicable law, platform rules, and third-party rights.

Where confusion could reasonably arise, the creator should identify the work as an unofficial interpretation, fan adaptation, or independently created work.

If an adaptation changes the lyrics, message, narrative, characters, setting, emotional meaning, or identity of the original work so substantially that it has effectively become a different work, it should not be presented as a cover or as an alternative version of the original song.

Where accurate, the creator may state that the new work was inspired by the original work. Such a statement must not suggest that The Sanctuary of Fragility participated in, approved, endorsed, or authorised the new work.

A substantially different work must not use the original song title, project name, identity, or reputation in a misleading manner, including primarily to attract attention, create commercial value, or market a new story that is no longer reasonably identifiable as a cover or adaptation of the original song.

Remix, Mashup, Medley, and Similar Uses

A remix, mashup, medley, edit, or comparable transformation created and used entirely through an official platform music library or another authorised platform feature may be used within the rights, functions, technical limits, and terms provided by that platform.

No form is required under this Cover and Adaptation Policy for such platform-based use, provided that the user remains within the authorised feature and does not extract, download, transfer, reproduce, or reuse the audio outside that system.

The user remains responsible for complying with the platform’s rules, licences, monetisation systems, content restrictions, and rights-management processes.

Outside an authorised platform feature, original audio controlled by The Sanctuary of Fragility must not be used to create a remix, mashup, medley, edit, or derivative recording.

A person creating such a work outside an authorised platform feature must use a newly recorded cover master that they have created or lawfully obtained and must hold or obtain the necessary rights in every other song, recording, sample, performance, and element included in the work.

Where a remix, mashup, medley, or similar work is made from a lawfully created cover master and is published only through an ordinary online platform, including through the platform’s standard monetisation features, the creator must submit the General Cover Notification Form before publication.

Where the work will be released through a distributor, the creator must submit the Metadata Request Form, wait for a response, and receive confirmation of the relevant metadata before submitting the release.

Adaptations and Special Uses Requiring Separate Review

The following uses are not authorised as ordinary covers or ordinary fan works and require submission of the Collaboration, Commercial Use, and Special Permission Enquiry Form:

𑇐 commercial adaptations of the lyrics, music, message, narrative, characters, setting, or identity of a song;

𑇐 sponsored, branded, advertising, promotional, or campaign-related adaptations;

𑇐 adaptations for film, television, theatre, musical productions, games, applications, podcasts, audiobooks, exhibitions, installations, interactive experiences, or comparable media;

𑇐 adaptations used to promote a product, service, business, clinic, institution, organisation, public event, public figure, charitable activity, or other commercial or organised project, subject always to Section 19;

𑇐 commissioned adaptations;

𑇐 proposed official adaptations or official human-performed versions;

𑇐 requests to use original audio;

𑇐 adaptations involving unreleased materials;

𑇐 substantial lyrical rewrites intended for commercial release or exploitation;

𑇐 uses that may create a formal, promotional, financial, reputational, or institutional association between The Sanctuary of Fragility and another person, artist, brand, organisation, institution, or project; and

𑇐 other uses outside the permissions expressly provided by this policy.

The form is an initial enquiry only. Submission does not grant permission, create an obligation to negotiate, reserve any rights, establish a collaboration, or authorise the proposed use.

The proposed use must not begin unless and until The Sanctuary of Fragility has expressly approved it in writing and all necessary terms, licences, payments, credits, approvals, and agreements have been completed.

Where appropriate, an approved proposal may be developed as a separately negotiated commission, official collaboration, licensed project, campaign, special release, or other arrangement. The terms and status of that project will be governed by a separate written agreement rather than by the general permissions in this policy.

The Sanctuary of Fragility may approve, decline, limit, or propose a different structure for any request. Nothing in this section creates an expectation that any proposed adaptation, collaboration, licence, or commercial use will be accepted.

Uses for which this policy does not grant permission under Section 19 are not converted into ordinary permission requests merely by submitting the form.

18. Interpretation, Context, and Non-Endorsement

A cover artist or fan creator may interpret a song through their own voice, performance style, visual presentation, personal experience, artistic perspective, or creative context, subject to this policy.

The interpretation, opinions, messages, conduct, and surrounding content of an independently created cover, fan work, translation, adaptation, performance, video, post, livestream, or publication belong to and remain the responsibility of the person who created or published them.

Unless expressly confirmed in writing for a specific project, The Sanctuary of Fragility does not:

𑇐 review or approve the interpretation;

𑇐 supervise the creation or publication;

𑇐 verify the accuracy of accompanying statements;

𑇐 endorse the creator, performer, account, organisation, product, service, campaign, cause, belief, or surrounding content;

𑇐 agree with every message, opinion, implication, or association arising from the use;

𑇐 accept responsibility for the creator’s actions, statements, or conduct; or

𑇐 participate in an official collaboration.

A person must not state or imply that The Sanctuary of Fragility approved, endorsed, or participated in a particular interpretation merely because:

𑇐 the work complies with this policy;

𑇐 a notification form was submitted;

𑇐 metadata was provided or confirmed;

𑇐 the work was not removed, challenged, or reported;

𑇐 The Sanctuary of Fragility became aware of the work;

𑇐 The Sanctuary of Fragility viewed, liked, commented on, acknowledged, shared, or reposted the work;

𑇐 a platform permitted or enabled the use;

𑇐 a distributor accepted the release;

𑇐 the work was monetised; or

𑇐 a rights-management claim was or was not made.

Silence, lack of enforcement, platform availability, monetisation, metadata confirmation, or ordinary social-media interaction does not constitute permission, endorsement, sponsorship, official status, or agreement with the context in which the work appears.

The Sanctuary of Fragility may appreciate, acknowledge, share, or promote an independently created work without accepting responsibility for all other content, statements, conduct, products, organisations, or views associated with its creator.

A share, repost, comment, acknowledgement, or other ordinary interaction does not:

𑇐 transfer ownership;

𑇐 create an unrestricted or continuing licence;

𑇐 convert an unofficial work into an official version;

𑇐 approve every context in which the work appears;

𑇐 establish an official collaboration; or

𑇐 create a continuing professional or organisational relationship.

This section does not prevent The Sanctuary of Fragility from expressly approving, endorsing, commissioning, or collaborating on a specific project through a separate written agreement.

Any such official relationship applies only to the particular project, parties, scope, materials, period, platforms, territory, and purposes confirmed in writing. It must not be treated as general or continuing approval of other works, activities, opinions, organisations, or future uses.

Where a person acts under an independent legal right or through an authorised platform feature, that right or platform permission does not turn the person’s interpretation, message, or surrounding context into an official position of The Sanctuary of Fragility.

19. Political, Religious, Propaganda, Hateful, and Violent Uses

The Sanctuary of Fragility intends to remain independent from political parties, candidates, electoral movements, religious institutions, religious recruitment campaigns, sects, cults, and ideological propaganda projects.

The Sanctuary of Fragility does not grant permission under this policy for covers, adaptations, performances, recordings, or related uses created for, commissioned by, or incorporated into:

𑇐 political campaigning;

𑇐 political parties;

𑇐 the support of or opposition to a political candidate;

𑇐 electoral activity;

𑇐 partisan political advocacy;

𑇐 political or ideological propaganda;

𑇐 recruitment into a political or ideological movement;

𑇐 religious campaigning, conversion efforts, recruitment, or propaganda;

𑇐 the promotion of a religious institution, sect, cult, or belief system;

𑇐 fundraising for a political organisation, ideological movement, political campaign, religious movement, sect, cult, or comparable activity;

𑇐 content that promotes, endorses, excuses, normalises, or supports hatred;

𑇐 discriminatory or dehumanising content;

𑇐 targeted harassment, intimidation, humiliation, or abuse;

𑇐 threats or incitement to violence;

𑇐 content that glorifies, encourages, instructs, excuses, or celebrates violence;

𑇐 extremist recruitment or promotion;

𑇐 terrorism, violent extremism, or unlawful violent organisations; or

𑇐 content that falsely claims that such positions, activities, or views belong to or are endorsed by The Sanctuary of Fragility.

These uses are not authorised as ordinary covers, ordinary adaptations, official collaborations, promotional projects, or special-permission uses under this policy.

Submission of the Collaboration, Commercial Use, and Special Permission Enquiry Form does not create a route for obtaining endorsement or official participation in such activities.

Nothing in this section is intended to prevent independent discussion, criticism, reporting, education, documentary analysis, commentary, satire, personal testimony, or other uses that may be permitted without authorisation under applicable law.

However, such use must not falsely imply that The Sanctuary of Fragility has reviewed, approved, endorsed, sponsored, participated in, or agreed with the use or the views expressed through it.

Where applicable law permits a person to use protected material without permission from The Sanctuary of Fragility, the existence of that legal right does not mean that The Sanctuary of Fragility has granted permission or accepted any association with the use.

Where a person uses audio through an official platform music library or another authorised platform feature, The Sanctuary of Fragility may not be able to approve, monitor, or prevent every use in advance.

Availability through a platform feature does not mean that The Sanctuary of Fragility has reviewed or endorsed the user, account, message, organisation, movement, belief, campaign, or surrounding content.

Within the limits of applicable law, platform rules, and available rights-management procedures, The Sanctuary of Fragility may:

𑇐 state publicly that it is not involved;

𑇐 request correction of a false statement or association;

𑇐 report or challenge a misleading use;

𑇐 request removal where an appropriate basis exists; or

𑇐 take other lawful and proportionate action.

The inability or decision not to take action against a particular use does not amount to approval, endorsement, participation, or agreement.

20. Charitable, Humanitarian, Health, Therapy, and Other Sensitive Uses

The Sanctuary of Fragility recognises that a song or cover may have personal meaning in charitable, humanitarian, community, educational, health-related, therapeutic, memorial, crisis-support, fundraising, or other sensitive contexts.

However, a compassionate, charitable, or socially beneficial purpose does not automatically make a use an ordinary cover or grant permission to associate The Sanctuary of Fragility with an organisation, service, campaign, treatment, activity, or claim.

An individual may ordinarily perform or share a compliant cover as a personal expression of comfort, remembrance, support, solidarity, awareness, or lived experience, provided that the use:

𑇐 is not commissioned, sponsored, branded, or organised as a promotional or fundraising campaign;

𑇐 does not falsely imply official participation, partnership, or endorsement;

𑇐 does not make medical, psychological, therapeutic, legal, financial, or other professional claims on behalf of The Sanctuary of Fragility;

𑇐 does not suggest that the song is a treatment, cure, diagnosis, clinical tool, or substitute for professional support;

𑇐 does not misrepresent the purpose or destination of any money raised; and

𑇐 otherwise complies with this policy.

The Collaboration, Commercial Use, and Special Permission Enquiry Form must be submitted where a song, lyrics, cover, project name, or other protected material will be used in connection with:

𑇐 a charity, foundation, nonprofit organisation, community organisation, or humanitarian body;

𑇐 a fundraising campaign or donation drive;

𑇐 a hospital, clinic, therapy practice, counselling service, health service, or wellness provider;

𑇐 a public-health, mental-health, medical, therapeutic, or crisis-support campaign;

𑇐 an educational institution or organised educational programme;

𑇐 a memorial, awareness campaign, public event, social-impact project, or institutional initiative;

𑇐 a sponsored or branded charitable activity;

𑇐 the sale of a release, product, ticket, service, or campaign item connected to a charitable or sensitive purpose;

𑇐 a claim that a song or project has been approved for therapeutic, clinical, educational, or professional use; or

𑇐 another organised use that may create a formal, promotional, financial, reputational, or institutional association with The Sanctuary of Fragility.

The form is used to provide preliminary information for review. Submission does not mean that the organisation, campaign, service, event, treatment, claim, fundraising method, or proposed use has been approved.

The proposed use must not begin until The Sanctuary of Fragility has provided express written permission and all necessary terms have been agreed.

Review may include:

𑇐 the identity, conduct, and reputation of the parties;

𑇐 the purpose and intended audience;

𑇐 the accuracy and sensitivity of the message;

𑇐 the way the song and project name will be presented;

𑇐 fundraising and financial transparency;

𑇐 revenue, donations, costs, and accounting;

𑇐 safeguarding and participant welfare;

𑇐 medical, therapeutic, educational, or professional claims;

𑇐 political, religious, ideological, or organisational affiliations;

𑇐 the duration, territory, media, and promotional scope of the use; and

𑇐 the likely effect of the proposed association on the project and its audience.

The Sanctuary of Fragility may approve, decline, limit, or propose a different structure for the project.

An approved sensitive, charitable, humanitarian, educational, or social-impact project may, where appropriate, be developed as a formal collaboration, commissioned project, shared campaign, special release, fundraising activity, or another separately agreed arrangement.

Nothing in this section permits a project that conflicts with Section 19.

Nothing in this section prevents The Sanctuary of Fragility from deliberately choosing to participate in appropriate charitable, humanitarian, health-related, educational, or social-impact work. It ensures that such participation is accurate, appropriately structured, separately reviewed, and confirmed in writing.

21. False Affiliation, Misrepresentation, and Reputation Laundering

A person must not use a song, cover, translation, adaptation, project name, credit, artwork, official link, social-media interaction, metadata confirmation, or other connection to The Sanctuary of Fragility in a manner that falsely creates, exaggerates, or prolongs an official relationship.

Without express written confirmation for a specific project, a person must not state or imply that The Sanctuary of Fragility:

𑇐 produced, commissioned, approved, authorised, endorsed, sponsored, supervised, or released the work;

𑇐 is collaborating or partnering with the person or organisation;

𑇐 supports a product, service, business, clinic, institution, charity, campaign, event, political position, religious position, cause, belief, or public statement;

𑇐 has verified the creator’s identity, conduct, claims, qualifications, reputation, safety, or professional services;

𑇐 has approved the use of donations, revenue, fundraising claims, or campaign proceeds;

𑇐 is represented by, affiliated with, or responsible for the user;

𑇐 has granted broader rights than those expressly provided by this policy or a separate written agreement; or

𑇐 has waived, transferred, abandoned, or failed to retain any rights.

A person must not manipulate or selectively use credits, artwork, titles, thumbnails, metadata, quotations, screenshots, links, tags, logos, project descriptions, messages, or social-media interactions to manufacture the appearance of an official relationship.

The following do not establish official affiliation, approval, endorsement, sponsorship, or collaboration:

𑇐 compliance with this policy;

𑇐 submission of a form;

𑇐 receipt or confirmation of metadata;

𑇐 silence or absence of enforcement;

𑇐 availability through a platform feature;

𑇐 distributor acceptance;

𑇐 monetisation;

𑇐 a copyright or rights-management claim;

𑇐 a private or public response;

𑇐 a like, follow, comment, acknowledgement, share, repost, or mention; or

𑇐 previous permission granted for a different work or purpose.

Permission for one project, song, campaign, platform, period, territory, party, or purpose does not create permission for another.

A past collaboration or official relationship must not be used to imply current, continuing, exclusive, or broader support after the agreed project, purpose, or period has ended.

A person who is independently entitled by law or platform rules to make a particular use must not present that independent right as evidence that The Sanctuary of Fragility granted permission or joined the activity.

The name, reputation, emotional meaning, social purpose, or audience trust associated with The Sanctuary of Fragility must not be used to conceal, repair, soften, or rehabilitate the public image of a person, organisation, product, service, campaign, or institution without prior written agreement.

This includes uses intended to suggest that a person or organisation:

𑇐 has been forgiven, accepted, validated, rehabilitated, or approved by The Sanctuary of Fragility;

𑇐 shares the project’s values merely because it used, licensed, funded, or promoted a song;

𑇐 is safe, ethical, trustworthy, charitable, therapeutic, socially responsible, or politically neutral because of an association with the project; or

𑇐 has resolved previous misconduct, controversy, criticism, or reputational harm through the use of the work.

The Sanctuary of Fragility may request correction, clarification, removal of misleading claims, separation of profiles or accounts, revised credits, withdrawal of promotional materials, or other reasonable action where a false, exaggerated, or outdated association has been created.

Where appropriate and legally available, The Sanctuary of Fragility or a party authorised to act within the specific scope of written authority may report, dispute, challenge, or pursue other proportionate remedies through a platform, distributor, advertiser, sponsor, administrator, service provider, contractual process, or applicable law.

The absence of action does not mean that the association is accurate, approved, endorsed, or accepted.

22. Sharing and Reposting Covers

A cover artist retains any rights they lawfully hold in their newly recorded cover master, performance, production, arrangement, artwork, video, and other original materials they create for the cover.

Publishing a cover, submitting a form, providing metadata, tagging The Sanctuary of Fragility, or otherwise bringing the work to the project’s attention does not transfer ownership of the cover or its independently created materials to The Sanctuary of Fragility.

Unless the cover artist has communicated a different preference, The Sanctuary of Fragility may:

𑇐 share or repost the original public post through the ordinary functions of the relevant platform;

𑇐 link to the original public post or release;

𑇐 embed a publicly available post, video, or player where the relevant platform permits embedding;

𑇐 mention or feature the cover in a list, playlist, community post, website page, newsletter, or similar project communication; and

𑇐 use the platform-generated preview, thumbnail, title, account name, or other information ordinarily displayed when sharing or linking to the original post.

The Sanctuary of Fragility will make reasonable efforts to identify and credit the cover artist when sharing, reposting, embedding, or linking to the work.

A cover artist may state through the applicable form or by contacting The Sanctuary of Fragility that they do not wish their work to be shared, reposted, embedded, linked, featured, or otherwise promoted by the project.

The Sanctuary of Fragility will respect a reasonable request concerning the visibility or promotion of the cover, including a request made after the work has already been shared, where it is reasonably possible to remove or discontinue the relevant project-controlled sharing.

A request not to share or promote the work does not require The Sanctuary of Fragility to:

𑇐 remove material from an account, platform, distributor, website, or service not controlled by The Sanctuary of Fragility;

𑇐 conceal or ignore infringement, misleading attribution, false affiliation, or another policy violation;

𑇐 withdraw a lawful rights-management claim;

𑇐 surrender, waive, or limit any right held by The Sanctuary of Fragility;

𑇐 remove factual records reasonably necessary for legal, administrative, safety, or rights-management purposes; or

𑇐 accept conditions unrelated to the sharing or promotion of the cover.

Ordinary sharing, reposting, embedding, linking, mentioning, or featuring does not:

𑇐 transfer ownership of the cover to The Sanctuary of Fragility;

𑇐 grant The Sanctuary of Fragility an unrestricted or permanent licence;

𑇐 make the cover an official release or official version;

𑇐 create an official collaboration;

𑇐 imply approval of all surrounding content, statements, products, services, organisations, or conduct associated with the cover artist; or

𑇐 authorise either party to use the other party’s materials beyond the rights otherwise available under this policy or applicable law.

The Sanctuary of Fragility must obtain separate permission from the cover artist before using the cover artist’s master, performance, video, artwork, photographs, or other independently created materials beyond ordinary sharing, reposting, embedding, linking, or comparable public-platform functions.

Separate permission may be required, for example, before:

𑇐 downloading and re-uploading the cover artist’s file;

𑇐 editing, excerpting, remixing, or materially altering the cover artist’s work;

𑇐 incorporating it into an official music video, advertisement, trailer, compilation, product, release, or campaign;

𑇐 distributing the cover artist’s master through another account, platform, or distributor;

𑇐 using the cover artist’s name, image, voice, or performance in paid promotion; or

𑇐 otherwise exploiting the cover artist’s work outside the context in which it was originally published.

Any such permission should identify the intended use, materials, platforms, period, credits, compensation where applicable, and other relevant conditions.

23. Official Collaborations

An independently created cover does not become an official collaboration merely because it complies with this policy, uses an official language version, receives metadata, generates revenue, attracts public attention, or is viewed, acknowledged, shared, or reposted by The Sanctuary of Fragility.

An official collaboration exists only where The Sanctuary of Fragility and the relevant collaborator have expressly agreed in writing to create, release, promote, or otherwise participate in a specific project together.

Official collaborations may include, where separately agreed:

𑇐 an official human-performed version;

𑇐 a newly commissioned recording;

𑇐 a jointly developed musical release;

𑇐 a collaboration between The Sanctuary of Fragility and another artist, performer, producer, organisation, or creative project;

𑇐 a special version, campaign, event, charitable activity, educational project, or social-impact initiative;

𑇐 official visual, narrative, promotional, or interactive materials;

𑇐 shared promotional activity; or

𑇐 another project expressly recognised as an official collaboration.

Submission of the Collaboration, Commercial Use, and Special Permission Enquiry Form is only an initial enquiry. It does not:

𑇐 create an official collaboration;

𑇐 require The Sanctuary of Fragility to respond, negotiate, accept, or proceed;

𑇐 grant permission to begin recording, publishing, promoting, fundraising, or using protected materials;

𑇐 reserve a song, concept, project, collaborator, release period, or commercial opportunity;

𑇐 establish confidentiality, exclusivity, representation, agency, partnership, employment, or joint ownership; or

𑇐 create an obligation to provide reasons if the proposal is declined.

A proposed collaboration must not begin or be publicly announced as official unless and until the parties have agreed in writing on the relevant terms.

Depending on the project, a separate written agreement may address:

𑇐 the specific song, version, recording, campaign, event, or activity;

𑇐 the role and responsibilities of each party;

𑇐 creative direction and approval procedures;

𑇐 lyrics, arrangement, performance, production, recording, and delivery;

𑇐 ownership or control of the new master recording;

𑇐 licences granted for the underlying song, lyrics, project materials, and promotional assets;

𑇐 credits, naming order, artist billing, and public presentation;

𑇐 use of project names, logos, likenesses, voices, photographs, and other brand materials;

𑇐 release platforms, distributors, territories, formats, and release dates;

𑇐 revenue, royalties, fees, expenses, donations, fundraising, and accounting;

𑇐 marketing, publicity, events, and promotional obligations;

𑇐 Content ID, metadata, publishing, and rights administration;

𑇐 confidentiality, safeguarding, conduct, and reputational matters;

𑇐 the duration and termination of the relationship; and

𑇐 permitted and prohibited uses after the project ends.

Unless a written agreement expressly provides otherwise, an official collaboration does not transfer ownership of the underlying song, original lyrics, official lyrical adaptations, project identity, or other existing materials of The Sanctuary of Fragility.

Similarly, The Sanctuary of Fragility does not acquire ownership of a collaborator’s pre-existing name, brand, performance, recording, artwork, or other materials merely because the parties collaborate.

Each party retains ownership or control of its pre-existing materials, subject to any limited licences expressly granted for the collaboration.

Rights in a newly created master, performance, arrangement, production, artwork, campaign, or other collaborative material will be determined by the written agreement for that project.

Permission or official status granted for one collaboration applies only to the agreed project, parties, materials, platforms, territory, period, and purposes. It does not create a general right to use other songs, materials, project elements, or future releases.

A collaborator must not continue to describe a relationship as current, official, exclusive, or ongoing after the agreed collaboration or permission has ended, unless the parties have confirmed otherwise in writing.

24. Notice, Correction, Reporting, and Enforcement

The Sanctuary of Fragility aims to address concerns in a proportionate manner, taking into account the nature of the use, the seriousness of the issue, the available information, the conduct of the user, applicable law, platform procedures, and the practical ability of the project to respond.

Where appropriate, The Sanctuary of Fragility may begin by contacting the relevant person or service to request:

𑇐 clarification of the use;

𑇐 correction of inaccurate credit or metadata;

𑇐 addition of an appropriate unofficial-status notice;

𑇐 correction of a false statement, endorsement, or affiliation;

𑇐 removal of the project name, artwork, profile, or other misleading material;

𑇐 correction or withdrawal of an excessive rights claim;

𑇐 separation of an incorrectly mapped artist profile;

𑇐 compliance with a form, permission, licence, or agreement requirement;

𑇐 removal, limitation, or discontinuation of a use; or

𑇐 another reasonable corrective action.

The Sanctuary of Fragility is not required to contact a user privately before taking another form of action where:

𑇐 the conduct appears deliberate, fraudulent, dangerous, abusive, or unlawful;

𑇐 there is an urgent risk of harm;

𑇐 a false rights claim is interfering with an official release or lawful rights administration;

𑇐 original audio or unreleased material has been obtained or used without authorisation;

𑇐 the use involves impersonation, hate, harassment, violent incitement, fraud, malicious deception, or serious reputational harm;

𑇐 previous contact has been ignored or has not resolved the issue;

𑇐 the identity or contact information of the responsible party is unavailable;

𑇐 a platform, distributor, advertiser, administrator, or legal process requires direct reporting; or

𑇐 prior contact would be impractical, unsafe, or likely to worsen the harm.

Depending on the circumstances, The Sanctuary of Fragility or a party authorised to act within the specific scope of written authority may:

𑇐 contact the user, platform, distributor, publisher administrator, rights administrator, advertiser, sponsor, service provider, or other relevant party;

𑇐 submit a correction request;

𑇐 request release or withdrawal of an inaccurate claim;

𑇐 submit a platform or distributor report;

𑇐 request separation or correction of artist profiles and metadata;

𑇐 issue a public clarification or denial of affiliation;

𑇐 request removal, restriction, demonetisation, exclusion, or discontinuation where an appropriate basis exists;

𑇐 use contractual, licensing, administrative, dispute-resolution, or rights-management procedures;

𑇐 preserve relevant evidence and records; or

𑇐 pursue another lawful and proportionate remedy.

The choice not to act immediately, or not to take the same action in every case, does not mean that:

𑇐 the use is authorised;

𑇐 the conduct complies with this policy;

𑇐 The Sanctuary of Fragility approves or endorses the use;

𑇐 any right has been waived or abandoned;

𑇐 similar uses will be treated in the same way; or

𑇐 future action is excluded.

The Sanctuary of Fragility may take into account good-faith mistakes, prompt correction, cooperation, scale, audience, commercial impact, harm, repetition, and other relevant circumstances when deciding how to respond.

Nothing in this policy requires The Sanctuary of Fragility to monitor every use, investigate every report, respond to every message, commence legal proceedings, or use every available remedy.

The Sanctuary of Fragility does not guarantee that a platform, distributor, service provider, administrator, advertiser, sponsor, or other third party will accept or act upon a report or request.

A person who receives a correction or removal request remains responsible for obtaining independent advice where necessary and for complying with applicable law, platform rules, licences, and contractual obligations.

25. Independent Legal Uses

Nothing in this policy is intended to restrict, remove, override, or misrepresent any use that applicable law permits a person to make without permission from The Sanctuary of Fragility.

Depending on the applicable law and the circumstances, such uses may include statutory exceptions, limitations, quotation, criticism, review, reporting, research, education, parody, satire, commentary, accessibility, archival activity, or other independently lawful uses.

The existence and scope of any legal exception depend on the relevant jurisdiction, purpose, amount used, nature of the material, context, market effect, and other applicable legal factors.

The Sanctuary of Fragility does not determine through this policy whether a particular use qualifies for a legal exception.

A person relying on an independent legal right remains responsible for determining whether the use is lawful and for obtaining independent legal advice where appropriate.

The fact that a person may have an independent legal right to use material does not mean that The Sanctuary of Fragility has:

𑇐 granted permission;

𑇐 approved the use;

𑇐 endorsed the interpretation, message, person, organisation, product, service, or surrounding context;

𑇐 participated in the creation or publication;

𑇐 entered into a collaboration;

𑇐 agreed that the use is accurate, fair, respectful, or consistent with the project’s values; or

𑇐 waived any right outside the scope of the applicable legal exception.

A person must not present an independently lawful use as evidence of permission, approval, sponsorship, affiliation, or official status from The Sanctuary of Fragility.

Where an independently lawful use exceeds the scope of the relevant legal exception, any additional use remains subject to applicable copyright, licensing, personality, privacy, trademark, contractual, platform, and other legal requirements.

Nothing in this section limits The Sanctuary of Fragility from:

𑇐 disputing whether a claimed legal exception actually applies;

𑇐 requesting clarification or correction;

𑇐 responding to false attribution or misleading affiliation;

𑇐 protecting rights not covered by the claimed exception;

𑇐 acting against uses that include separate unlawful conduct; or

𑇐 seeking an appropriate determination through a platform, distributor, contractual, administrative, or legal process.

The availability of a work through an official platform music library, platform feature, streaming service, website, or other authorised channel does not itself create a legal exception or grant rights beyond those provided by the applicable platform terms, licence, or law.

26. Notification Forms and Permission Requests

The Sanctuary of Fragility provides different forms for different types of cover, distribution, collaboration, commercial use, and special-permission enquiries.

Using the correct form helps The Sanctuary of Fragility understand the proposed use, provide relevant information, maintain accurate records, and distinguish ordinary covers from uses that require separate review or written agreement.

General Cover Notification Form

The General Cover Notification Form is intended for ordinary covers shared through online platforms, including covers using the platform’s standard monetisation features, where the use otherwise complies with this policy.

It is a notification form rather than an application for individual approval.

A person submitting a compliant General Cover Notification Form does not ordinarily need to wait for a response before publishing the cover.

Submission of the form does not:

𑇐 make the cover an official version;

𑇐 create an official collaboration;

𑇐 authorise distributor release;

𑇐 authorise sponsored, branded, advertising, campaign, or other special commercial use;

𑇐 authorise the use of original audio controlled by The Sanctuary of Fragility;

𑇐 authorise the use of unreleased materials; or

𑇐 grant rights beyond those expressly provided by this policy and applicable law.

Metadata Request Form

The Metadata Request Form is intended for covers, medleys, mashups, remixes made from lawfully created cover masters, and other eligible works that will be submitted through a music distributor.

The person submitting the form must wait for a response and receive confirmation of the relevant metadata before submitting the release to the distributor.

Submitting the form does not guarantee:

𑇐 that the proposed release is eligible for distribution;

𑇐 that a distributor will accept the release;

𑇐 that a particular artist name, profile, title, credit, identifier, or metadata format will be approved;

𑇐 that no additional licence, allocation, payment, or rights-management arrangement will be required; or

𑇐 that the proposed release will be treated as an official version or collaboration.

The person releasing the cover remains responsible for complying with distributor requirements, platform rules, applicable law, third-party rights, and any additional instructions provided for the particular release.

Collaboration, Commercial Use, and Special Permission Enquiry Form

The Collaboration, Commercial Use, and Special Permission Enquiry Form is intended for proposals involving matters such as:

𑇐 official collaborations;

𑇐 commissioned recordings or productions;

𑇐 sponsored, branded, advertising, promotional, or campaign uses;

𑇐 commercial adaptations;

𑇐 film, television, theatre, game, podcast, application, exhibition, or other media uses;

𑇐 charitable, humanitarian, educational, health-related, therapeutic, fundraising, or other organised sensitive uses;

𑇐 substantial lyrical, narrative, or creative adaptations;

𑇐 requests involving original audio;

𑇐 requests involving materials that are not available under the ordinary permissions in this policy; or

𑇐 other proposed uses requiring separate review, negotiation, or written permission.

This form is a preliminary enquiry only.

Submission does not:

𑇐 grant permission;

𑇐 authorise the proposed use to begin;

𑇐 create an official collaboration;

𑇐 require The Sanctuary of Fragility to accept, negotiate, respond to, or proceed with the proposal;

𑇐 reserve any song, material, collaborator, concept, release date, opportunity, or right;

𑇐 establish confidentiality, exclusivity, representation, partnership, employment, or joint ownership; or

𑇐 guarantee that an agreement will be offered.

The proposed use must not begin or be publicly presented as approved or official unless and until The Sanctuary of Fragility has expressly confirmed its approval in writing and all necessary terms and agreements have been completed.

General Form Terms

The person submitting a form is responsible for providing information that is accurate, complete, current, and not misleading.

The Sanctuary of Fragility may request clarification or additional information where necessary.

An incomplete, inaccurate, misleading, duplicate, or incorrectly submitted form may delay or prevent a response.

Submitting one form does not replace another form where the nature of the use changes. For example:

𑇐 an ordinary online cover that later becomes a distributor release may require the Metadata Request Form;

𑇐 a cover that later becomes sponsored, branded, commissioned, or connected to a campaign may require the Collaboration, Commercial Use, and Special Permission Enquiry Form; and

𑇐 a proposal that changes materially after review may require updated information or a new enquiry.

A form submission applies only to the work, version, person, account, platform, release, purpose, and other details identified in that submission.

It does not automatically apply to:

𑇐 another song or version;

𑇐 another performer or collaborator;

𑇐 another account, channel, artist profile, platform, or distributor;

𑇐 another release format, territory, campaign, or commercial purpose;

𑇐 a later adaptation or revised recording; or

𑇐 a future use not accurately described in the original submission.

The Sanctuary of Fragility may change, replace, suspend, or discontinue a form or its procedures where reasonably necessary.

The applicable form, instructions, and requirements are those made available by The Sanctuary of Fragility at the time of the relevant submission, subject to any separate written agreement.

27. Song-Specific, Release-Specific, and Collaboration-Specific Terms

Some songs, recordings, releases, language versions, collaborations, campaigns, platform uses, or other project materials may be subject to additional or different terms.

Such terms may be provided through:

𑇐 a notice accompanying a particular song or release;

𑇐 an official song, lyrics, credits, or information page;

𑇐 release metadata or liner information;

𑇐 a platform-specific notice;

𑇐 instructions connected to a form response;

𑇐 a written permission, licence, commission, or collaboration agreement;

𑇐 terms issued for a particular campaign, event, programme, or project; or

𑇐 another official communication from The Sanctuary of Fragility.

Additional terms may address matters such as:

𑇐 whether a particular song or version is available for covers or adaptations;

𑇐 which lyrics or language versions are official;

𑇐 required titles, credits, artist names, identifiers, or metadata;

𑇐 restrictions connected to a particular recording, arrangement, release, or collaborator;

𑇐 distributor and platform requirements;

𑇐 territory, duration, format, audience, or purpose;

𑇐 monetisation, royalties, revenue allocation, fees, donations, or accounting;

𑇐 use of names, artwork, logos, photographs, voices, performances, or promotional materials;

𑇐 Content ID and other rights-management arrangements;

𑇐 approval, review, delivery, release, marketing, or publicity procedures;

𑇐 confidentiality, safeguarding, conduct, or reputational requirements; and

𑇐 uses permitted or prohibited after a collaboration, campaign, or licence ends.

Song-specific or release-specific terms supplement this Cover and Adaptation Policy.

Where an official song-specific or release-specific term directly conflicts with a general provision of this policy, the more specific term will apply to that particular song, version, recording, release, platform, territory, period, or use to the extent of the conflict.

A written commission, licence, permission, or collaboration agreement applies according to its own terms.

Where such a written agreement directly conflicts with this policy, the written agreement will govern the parties and subject matter within its stated scope.

A special term or separate agreement does not change the rules for other songs, releases, collaborators, uses, or persons.

Permission, approval, metadata, or official status provided for one song, version, recording, release, collaboration, campaign, platform, territory, period, or purpose must not be treated as permission for another.

The person relying on a song-specific, release-specific, or collaboration-specific term is responsible for reviewing and complying with the complete applicable terms.

Where there is uncertainty about which terms apply, the person should contact The Sanctuary of Fragility before proceeding with a use that requires permission or confirmation.

End of the Cover and Adaptation Policy

The Cover and Adaptation Policy consists of Sections 1–27.

It governs the cover, performance, translation, adaptation, distribution, sharing, collaboration, and related uses addressed within those sections.

Other provisions of the Rights and Usage Policy remain separate from this Cover and Adaptation Policy and may also apply where relevant, including provisions concerning ownership, artificial-intelligence assistance, official platform music libraries, fan-created visual works, unreleased materials, and updates to the Rights and Usage Policy.

Nothing in this closing statement expands a permission beyond the scope expressly provided in Sections 1–27, any applicable song-specific or release-specific terms, or a separate written agreement.

Policy Updates

The Sanctuary of Fragility may revise, update, replace, reorganise, or clarify this Rights and Usage Policy from time to time to reflect changes in the project, its releases, creative activities, platforms, forms, rights-management practices, legal requirements, operational needs, or other relevant circumstances.

The current version of the Rights and Usage Policy will identify its effective date and, where applicable, the date on which it was last updated.

Effect of Updates

Unless otherwise stated, an updated version of this Rights and Usage Policy applies to:

𑇐 uses that begin on or after the effective date of the updated version;

𑇐 requests, notifications, submissions, and enquiries made on or after that date; and

𑇐 continuing uses after that date, to the extent reasonably applicable and permitted by law.

A person continuing an ongoing public, commercial, distributed, collaborative, or otherwise regulated use after an update is responsible for reviewing the current Policy and making reasonable adjustments where the updated terms apply to that continuing use.

The Sanctuary of Fragility will not treat an update as automatically rewriting the historical circumstances of a use that was completed before the updated version took effect.

Existing Written Agreements and Permissions

An update to this Rights and Usage Policy does not automatically amend, replace, cancel, or override a separate written agreement, licence, commission, collaboration agreement, or express written permission that was already in effect.

Such an agreement or permission continues to operate according to its own terms, including any provisions concerning:

𑇐 amendments;

𑇐 renewal;

𑇐 termination;

𑇐 suspension;

𑇐 continuing obligations;

𑇐 later policy versions; or

𑇐 incorporation of external terms.

Where a written agreement expressly states that the current version of this Rights and Usage Policy applies, the effect of a later update will be determined according to that agreement and applicable law.

Where a written agreement directly conflicts with a later version of this Policy, the written agreement will govern the parties and subject matter within its stated scope, unless the agreement itself provides otherwise.

Previously Granted Permissions

A permission expressly granted before an update will not ordinarily be withdrawn retroactively merely because the Policy has changed.

However, an existing permission may still be limited, suspended, withdrawn, or terminated where:

𑇐 the permission or agreement allows such action;

𑇐 the user materially changes the use, project, version, platform, parties, purpose, territory, or commercial context;

𑇐 the user provides inaccurate or misleading information;

𑇐 the user breaches the applicable terms;

𑇐 the use infringes or interferes with the rights of The Sanctuary of Fragility or another person;

𑇐 the use creates a serious safety, fraud, legal, reputational, or rights-management concern;

𑇐 continued permission would conflict with applicable law, a binding order, platform requirements, or third-party rights; or

𑇐 another lawful and proportionate reason exists.

Nothing in this section requires The Sanctuary of Fragility to continue a permission beyond its stated scope, duration, purpose, or conditions.

Material Changes and Notice

Where reasonably practical, The Sanctuary of Fragility may identify material changes through the Rights and Usage Policy page, an update notice, an official project channel, or another appropriate communication.

The Sanctuary of Fragility is not required to provide individual notice to every person who has previously viewed, relied on, submitted a form under, or used material in connection with this Policy.

Minor corrections, formatting changes, updated links, clearer wording, administrative changes, and revisions that do not materially alter permissions or obligations may be made without a separate announcement.

The absence of a separate announcement does not prevent an updated version from taking effect on its stated effective date.

Forms, Links, and Procedures

Forms, contact methods, submission procedures, platform instructions, metadata requirements, and administrative processes referenced in this Rights and Usage Policy may be updated separately from the main text.

The version of a form, instruction, or procedure available at the time of submission will ordinarily govern the information required for that submission.

However, submission of a form does not permanently fix or preserve the Policy, requirements, procedure, or decision-making criteria that applied on the submission date.

Where review, confirmation, negotiation, approval, or another required process remains incomplete when an updated Policy, form, instruction, or procedure takes effect, The Sanctuary of Fragility may apply the updated requirements to the remaining process.

Where reasonably necessary, The Sanctuary of Fragility may:

𑇐 request updated, corrected, or additional information;

𑇐 require the person to confirm that the proposal remains unchanged;

𑇐 provide new instructions;

𑇐 transfer the information to an updated procedure where appropriate;

𑇐 close, suspend, or discontinue the earlier submission; or

𑇐 require submission of a new or replacement form.

A pending submission does not grant permission, reserve rights, guarantee continued review under an earlier Policy, or create an entitlement to approval.

This does not ordinarily invalidate an action that was already properly completed before the update took effect. In particular, a compliant General Cover Notification Form that had already completed its notification function will not ordinarily become invalid merely because a later Policy or form version is introduced.

The Sanctuary of Fragility may temporarily suspend, close, replace, or restrict access to a form while the Policy, form, procedure, or administrative system is being updated.

A broken, outdated, relocated, suspended, closed, or replaced link or form does not by itself:

𑇐 expand a permission;

𑇐 remove or waive a requirement;

𑇐 convert a pending enquiry into an approval; or

𑇐 authorise a use that would otherwise require notification, confirmation, negotiation, or written permission.

Where a required form or page is temporarily unavailable, a person must not assume that the relevant requirement has been waived or that the proposed use may begin.

Unless The Sanctuary of Fragility expressly provides another method, the person should wait until the relevant form, page, or procedure becomes available or contact The Sanctuary of Fragility through the currently published official contact method.

Previous Versions

The Sanctuary of Fragility may retain previous versions of this Rights and Usage Policy for record-keeping, transparency, rights administration, or dispute-resolution purposes.

A previous version does not continue to govern a new use merely because it was more favourable to the user.

Where the timing of a use, permission, submission, or agreement is relevant, the applicable version will be determined by the effective dates, the nature and continuity of the use, any applicable written agreement, and applicable law.

No Expansion of Rights

An update, delay in updating, drafting error, omission, inconsistent wording, or temporary absence of information does not automatically:

𑇐 transfer ownership;

𑇐 grant an unrestricted licence;

𑇐 authorise the use of unreleased materials;

𑇐 create an official collaboration;

𑇐 waive rights;

𑇐 approve a use that otherwise requires permission; or

𑇐 prevent The Sanctuary of Fragility from clarifying or protecting its lawful rights.

Where wording is unclear, the Policy should be read together with applicable song-specific, release-specific, collaboration-specific, platform-specific, and written-agreement terms.

Questions about a material update or its application to a proposed use may be directed to The Sanctuary of Fragility through the contact method identified on the relevant Rights and Usage Policy or Notification Forms and Permission Requests page.

Contacting The Sanctuary of Fragility does not suspend the effective date of an update or authorise a use while clarification is pending.
